13. Noise generated on the property via the Conditional Use Permit shall comply with those outlined in <br />the MPCA Guide to Noise Control. <br />14. The changeable copy sign shall not exceed 70 square feet and must comply with the standards set <br />forth in Sec. 30-864 (e). A sign permit is required. <br />15. A Minnesota Department of Natural Resources (DNR) Appropriation Permit shall be required for <br />any water use that is above 10,000 gallons a day or totaling 1 million gallons or more within a year. <br />This includes snow -making applications and spraying for dust control and other construction needs. <br />16. Conditional Use Permit (CU 18-10) will become void upon the recording of this permit. <br />Background/Discussion <br />The subject property is east of Highway 169 between the 213Ih and <br />221" Avenue alignments. The property is zoned Extreme <br />Commercial Recreation (XCR) where Off -Road Racing Facilities <br />require a Conditional Use Permit (CUP). <br />The applicant requests an amendment to the previously approved <br />CUP to permit their track expansion completed about two years <br />ago, construct two roofed viewing structures, and install a <br />changeable copy sign (approximately 70 sq. ft.) along Hwy 169. <br />Overall, the current functions/activities on site will continue as they <br />have, but with the addition of a few structures. The conditions from <br />the 2018 CUP have been incorporated into this amendment. <br />To bring the track expansion into compliance the applicant has also <br />applied for a Platted Exemption (PE 22-01) to plat a portion of the <br />property to include the expanded track. <br />Planning Commission Meeting <br />The Planning Commission reviewed all standards required for <br />approval of a CUP and made comments and recommendations on <br />the following topics. <br />Figure <br />V <br />CR 33 - <br />3 <br />RR <br />Transportation/Circulation <br />The site has three access points to and from Highway 169. The submitted site plan shows two access points to <br />be used for spectators and one for participants/riders. A future third access is shown directly across from 213th <br />Avenue. <br />By the end of 2024, the 169 Redefine project will be complete and the conversion of US Highway 169 to a <br />freeway will greatly impact traffic patterns. Spectators/visitors to this property will see a lack of openings in <br />traffic and minimal opportunities to safely enter/cross US Highway 169. Staff recommended to the Planning <br />Commission that all ingress/egress functions related to the subject parcel/CUP shall occur at Brook Road and <br />all access points be removed on US Highway 169 by August 2024, or at a future CUP, whichever occurs first. <br />The recommended condition should also limit the excessive slowing down/stopping traffic occurring on <br />Highway 169. The applicant owns the necessary properties to establish a primary connection to Brook Road. <br />During the commission meeting, the applicant indicated they may not always own the properties, which would <br />depend on their long-term goals. <br />
