Request by the City of Elk River for Ordinance Amendment to Add Re,-iulations for <br />Lawn Fertilizer Application, Case No. OA 01-02 <br />Building and Zoning Administrator Steve Rohlf indicated that the city is proposing <br />an ordinance to regulate the application of lawn fertilizer. He noted that the <br />ordinance is intended to reduce phosphorus in the city's waterways. Steve noted <br />the ordinance requires commercial applicators to be licensed by the city. <br />Members of the Lake Orono Water Quality Task Force were present and <br />encouraged the adoption of the ordinance. <br />Mayor Klinzing noted that she had received a letter from the City of Shorewood <br />requesting the city of Elk River to adopt a resolution in support of legislation to <br />restrict the sale of phosphorus Lawn fertilizers. <br />The Council discussed the issue of being able to enforce this type of ordinance. <br />Steve Rohlf indicated that the ordinance would be more of a teaching tool than <br />a way of enforcement. Discussion was held regarding working with the retailers to <br />ensure that they will carry phosphorus free fertilizer. <br />Patrick Plant, 13184 Islandview Drive, member of the Lake Orono Water Quality <br />Task Force, noted that he has spoke to several of the local retailers regarding this <br />issue and that most of the retailers can provide this type of fertilizer, however, <br />some of the retailers would not provide the fertilizer. <br />COUNCILMEMBER TVEITE MOVED TO ADOPT ORDINANCE 01-02, ADDING SECTION <br />606 TO THE CITY OF ELK RIVER CODE OF ORDINANCES ENTITLED LAWN FERTILIZER <br />APPLICATION CONTROL, CASE NO. OA 01-02. COUNCILMEMBER DIETZ SECONDED <br />THE MOTION. THE MOTION CARRIED 5-0. <br />COUNCILMEMBER MOTIN MOVED TO ADOPT RESOLUTION 01-16 ADOPTING A FEE <br />OF $45.00 FOR COMMERCIAL LAWN FERTILIZER APPLICATOR LICENSE FOR 2001. <br />COUNCILMEMBER DIETZ SECONDED THE MOTION. THE MOTION CARRIED 5-0. <br />COUNCILMEMBER MOTIN MOVED TO ADOPT RESOLUTION 01-17 RELATING TO <br />RESTRICTIONS ON THE USE AND SALE OF PHOSPHORUS LAWN FERTILIZERS. <br />COUNCILMEMBER KUESTER SECONDED THE MOTION. THE MOTION CARRIED 5-0. <br />6.2. Re. ;uest by Cascade III for Final Plat A�r_.roval_ The Rid ;es of Rice Lake, Case No. <br />P 01-02 <br />Senior Planner Scott Harlicker noted that Dynamics Design and Land Company is <br />requesting final plat of Ridges of Rice Lake located on the north side of 2215r <br />Avenue at the Vernon Street alignment. The plat is a 273-acre cluster plat. Scott <br />noted that the preliminary plat was approved on February 20, 2001. The <br />preliminary plat included 70 single-family lots and 211 acres of open space. Scott <br />indicated that the final plat is consistent with the approved preliminary plat. <br />COUNCILMEMBER MOTIN MOVED TO ADOPT RESOLUTION 01-18 GRANTING FINAL <br />PLAT APPROVAL FOR RIDGES AT RICE LAKE, CASE NO.
