Leeseberg indicated that the <br />applicant is requesting an easement vacation to provide more buildable area on the lot by <br />vacating a portion of the existing drainage and utility easement located in the southwest <br />corner of the property located at 20321 Auburn Street. 11r. Leeseberg stated that this item <br />was brought before the Council on July 18, 2005 at which time the Council approved the <br />administrative subdivision but tabled the easement vacation due to lack of information. He <br />stated that there is currently an 80-foot Vlide ~asement from the street to the wetland and it <br />is not apparent why such a large easement was created '\vith the Deerfield First addition plat <br />as there are no utilities in the easement and the terrain in the easement east of the road is <br />higher than the road itself. 11r. Leeseberg indicated that the new parcel should have enough <br />buildable area to support a home pad, primary and secondary septic fields, and well location. <br /> <br />Mayor I<J.inzing opened the public hearing. EV 05-08 <br />WITH THE FOLLOWING CONDITIONS: <br /> <br />1. ALL COMMENTS FROM THE CITY ENGINEER SHALL BE <br />ADDRESSED. <br /> <br />2. Leeseberg indicated that the <br />applicant is requesting an easement vacation of drainage and utility easements to be able to <br />construct an approximately 23,630 sf Tractor Supply Store. 111:. Leeseberg stated that the <br />easement was created to protect a '\vetland but the amount of area of wetland that d1e <br />easement protected is Vlithin the de minimis amount '\vhich can be filled; therefore, there is <br />no need for a drainage and utility easement in this area. Leeseberg noted that there aIe <br />two portions of the easement that exist on Lot 2, Block 1 of this plat that cannot be vacated <br />'\\lith this request as they are on separate property. <br /> <br />Mayor I<Iinzing opened the public hearing.
