<br />o <br /> <br />o <br /> <br />o <br /> <br />Planning Commission Minutes <br />November 22, 1983 <br />Page Five <br /> <br />Commissioner Hartman questioned whether a zone change from R-la to R-lb would be <br />out of bounds because of the original layout of the whole area. Chairman Tracy <br />indicated that a zone change was compatible with the land use map. Chairman Tracy <br />questioned whether anyone would be opposed to the zone change. C'6mmissioReprFearce <br />indicated that he would not be opposed because it was not spot zoning. Commissioner <br />Ward indicated that he had a problem with the zone change, and wanted to know why <br />they were actually breaking the lots up. John Oliver indicated that the purpose <br />was to increase the yield. Commissioner Hartman indicated that he felt the zone <br />change would be OK. <br /> <br />Chairman Tracy indicated that four of the five commissioners recommended the zone <br />change to the City Council and that Darrell Ward was against this recommendation. <br /> <br />8. <br /> <br />Custom Motors Zone Change <br /> <br />Mr. Breezee reviewed with the Planning Commission Members that at the last Planning <br />Commission Meeting the Planning Commission had reviewed the land area presently <br />owned by Custom Motors, and that it was the unanimous decision by the Commission <br />to zone change the area from I-2/Medium Residential to R-lb/Single Family, and <br />that an amortization period from 5 to 10 years be required. Mr. Breezee indicated <br />that in the City Ordinance there is a requirement of an amortization period of a <br />maximum of 5 years, and that the City staff felt that in order to keep the ordinance <br />intact so that future problems do not develop, the ordinance should not be deviated <br />from. <br /> <br />Commissioner Oster questioned as to what kind of buildings were on the property. <br />Mr. Breezee indicated that they were metal-skinned pole barn buildings. Com- <br />missioner Pearce indicated that he had a problem with going less than 10 years <br />on an amortization period because of the investment put in by Custom Motors. <br />Commissioner Hartman felt that by changing the time limit, we are not taking <br />away the value of the land. Commissioner Hartman further indicated that if the <br />concept of having this is wrong for the area. a change has to be made. Com- <br />missioner Hartman questioned whether there was cause for concern about ground <br />contamination. Mr. Breezee indicated that he did some checking and found that <br />motor oil does not cause ground contamination. <br /> <br />After further discussion it was the general consensus of the Planning Commission <br />to leave the original motion stand as it previously read with a 5 to 10 year <br />amortization period. and negotiations done between the City and Custom Motors. <br /> <br />9. <br /> <br />Wapiti Park Zoning Designation <br /> <br />Mr. Rick Breezee explained that presently Wapiti Park is located in an R-lb section <br />of the City, and that because of this, the campground is a non-conforming use, and <br />as such they cannot expand or extend their present operation. Mr. Breezee further <br />explained that a zone change to A-l agricultural, which is where campgrounds are <br />only allowed presently within the ordinance, would not be appropriate because of <br />the land use. Mr. Breezee further indicated that he felt it would be best to amend <br />the ordinance to allow campgrounds as a conditional use in the R-lb zone. <br /> <br />Mr. Rick Breezee further indicated that the Camp on the Mississippi Campground is <br />also a non-conforming use. and that if the ordinance was amended to allow camp- <br />grounds as conditional uses in an R-lb area, this would also apply to this camp- <br />ground. <br />
