Staff does not see a need to impose <br /> specific conditions to satisfy this standard. <br /> 3. mill not impede the normal and orderly development and improvement of surrounding vacant property. <br /> While all the properties abutting the subject parcel on the east side have homes and other <br /> structures on them, they are larger parcels (16-70 acres) and could be subdivided in the future. <br /> Staff recommends no motorized events shall occur within 1,000 feet of any residence,livestock <br /> shelter, and/or arena, regardless of when they are erected. It is understood this can affect future <br /> uses on the subject parcels,but this is to ensure the normal and orderly development will not be <br /> impeded on surrounding properties. <br /> 4. mill be served adequately by and will not adversely affect essential public facilities and services including streets, <br /> police and fire protection, drainage, refuse disposal, mater and sewer systems,parks and schools;and will not, in <br /> particular, create traffic congestion or interference with traffic on adjacent and neighboring public thoroughfares. <br /> As stated before,by the end of 2024, the 169 Redefine project will be complete and with the <br /> conversion of US Highway 169 to a freeway,this will greatly affect traffic patterns in the area. <br /> Staff recommends that all ingress/egress functions related to the subject parcel/CUP occur at <br /> Brook Road and all access points be removed on US Highway 169 by August 2024, or at a future <br /> CUP,whichever occurs first. Staff will work with the applicant on the location of this Brook Road <br /> access. <br /> Portions of the subject parcels are now located in the Future Urban Service District.Although the <br /> current project does not require city services, some of the permitted and conditional uses in the <br /> XCR district will require city services and this will have to be addressed in the future. <br /> MnDOT has expressed concerns with past snow-making activities that have created hazardous <br /> conditions to the highway system. State statute X160.2715 - Right-Of-Way Use;Misdemeanors <br /> states it shall be unlawful to obstruct any highway or deposit snow or ice thereon. <br /> 5. mill not involve uses, activities,processes, materials, equipment and conditions of operation that will be detrimental <br /> to any persons or property because of excessive traffic, noise, smoke,fumes,glare, odors, dust or vibrations. <br /> Again, the main uses on the campus are racing in nature where varying levels of noise are <br /> expected. With hours of operation and the recommended condition of noise generated on the <br /> property via the Conditional Use Permit shall comply with those outlined in the MPCA Guide to <br /> Noise Control,this should regulate excessive noise. <br /> As for excessive traffic, the recommend condition of an alternate access point should limit <br /> excessive slowing down/stopping traffic on Highway 169. <br /> 6. Vill not result in the destruction, loss or damage of a natural, scenic or historic feature of major importance. <br /> The subject parcels that are a part of the CUP have a significant number of wetlands throughout. <br /> The applicant is having a wetland delineation completed on the parcels shown on the exhibit <br /> labeled "Wetland Delineations". Section 30-1852 of the ordinance outlines setbacks from <br /> wetlands. While the site plan dated 3/24/2022 shows the approximate locations of existing and <br /> future trails, staff will continually work with the applicant on the location of future trials to ensure <br /> they are not impacting wetlands and/or required buffers/setbacks. Other development/structures <br /> not shown on the site plan dated 3/24/2022 will require an amendment to the CUP. <br />
