<br />Han{itY)Lf QI, q I{)~ <br />ikrtL D.3, <br /> <br />RESOLUTION 05- <br /> <br />A RESOLUTION FOR THE CITY OF ELK RIVER <br /> <br />A RESOLUTION AUTHORIZING EMERGENCY REPLACEMENT OR REPAIR OF THE ICE <br />ARENA ROOF DAMAGED BY HAIL WITHOUT COMPETETIVE NOTICE OR <br />COMPETITIVE BIDS <br /> <br />WHEREAS Minnesota Statute 365.37, Subdivision 4 allows the city to contract without notice or <br />competitive bidding if a special emergency situation requires immediate action essential to <br />the health, safety, or welfare of the city; and <br /> <br />WHEREAS the Elk River Ice Arena has received damage from a hail storm that will result in continued <br />and serious loss to the property if the situation is not corrected immediately; and <br /> <br />WHEREAS ! the situation creates a serious threat to the health and safety of the people using the Ice <br />Arena; and, <br /> <br />WHEREAS the situation meets the criteria as an emergency situation given that it affects the health, <br />safety, or welfare of the community requiring immediate action, it occurred suddenly, and <br />the conditions of the building have worsened considerably as a result of the situation. <br /> <br />NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Elk River, Minnesota that <br />the Ice Arena roof severely damaged by hail be replaced without notice and without competitive bids as <br />authorized by Minnesota Statutes in order to minimize additional damage to the structure and to minimize <br />the health and safety threats to its users. <br /> <br />Passed and adopted by the City Council of the City of Elk River, Minnesota, this 19th day of September, <br />2005. <br /> <br />Stephanie A.
