Gary Santwire stated that the <br />intent of the True Value Home Center is to sell lumber as an accessory. <br />Rohlf stated that it was not the intent to deceive anybody on True Value <br />Home Center's behalf. <br /> <br />Discussion was <br />whether or not <br /> <br />held <br />True <br /> <br />between <br />Value <br /> <br />staff and <br />Home Center <br /> <br />the Planning Commission as to <br />is now a lumber yard or not. <br /> <br />Gary Santwire stated that the True Value Home Center did enter into this <br />willingly because they felt it only fair to place conditions and <br />regulations on such a lumber yard with the option to review these <br />conditions from time to time. <br /> <br />Pat Donahue stated that he has no problem with the request. <br /> <br />Floyd Ostrander questioned the transferability of a Conditional Use <br />Permit for a lumber yard. <br /> <br />Chairman Wilson closed the public hearing. <br /> <br />COMMISSIONER BARRETT MOVED TO RECOMMEND TO THE CITY COUNCIL APPROVAL OF <br />AN ORDINANCE AMENDING SECTION 900.16 - CONDITIONAL USES. SUBSECTION 7 - C- <br />4 SERVICE COMMERCIAL DISTRICT TO INCLUDE "H. LUMBER YARDS." COMMISSIONER <br />TEMPLE SECONDED THE MOTION. THE MOTION CARRIED 6-0. <br /> <br />10. <br /> <br />Request for Conditional Use Permit By Elk River True Value Home Center/ <br />Public Hearing <br /> <br />Elk River <br />requesting <br />4/Service <br />described <br />Village of <br /> <br />True Value Home Center of 555 <br />a conditional use permit <br />Commercial District. The <br />at Lots 3 and 4. Block. <br />Elk River Addition. <br /> <br />Railroad Drive. NW. Elk River is <br />to allow a lumber yard in a C- <br />property in question is legally <br />12 and Lots 1. 2 and 3. Block 13 <br /> <br />Rohlf clarified that this CUP is contingent upon the City Council <br />approving the ordinance amendment previously requested. <br /> <br />Discussion was held on the type of building True Value Home Center would <br />be building to house the lumber with Gary Santwire Representing the <br />business. The appearance of the building would be one large building <br />with a continuous roof but would actually be three separate buildings. <br />Height was also discussed at this time. Materials to be used for the <br />building and the type of fencing that would be put up were also questions <br />raised. <br />
