THE RECOMMENDATION OF DENIAL WAS BASED ON THE
FOLLOWING FINDINGS OF FACT:

1. THAT THE USE WOULD HAVE AN ADVERSE IMPACT ON THE SURROUNDING
NEIGHBORHOOD DUE TO TRAFFIC AND THE COMMERCIAL NATURE OF THE USE.

2. THAT THE APPLICANTS ARE NOT IN COMPLIANCE WITH THE STIPULATION OF
THEIR PREVIOUS CONDITIONAL USE PERMIT REQUEST.

3. RESIDENTS TESTIMONY REGARDING THE ADVERSE IMPACT ON PROPERTY
VALUES AND MAINTENANCE OF THE RESIDENTIAL NATURE OF THE
NEIGHBORHOOD.

4. SAFETY CONCERNS RELATING TO ADDITIONAL TRAFFIC IN RESIDENTIAL
NEIGHBORHOOD.

COMMISSIONER JOHNSON SECONDED THE REQUEST. THE MOTION CARRIED 6-0.

6. Consider Conditional Use Permit by Grace Ostien (Additional Metal
S}{inD,ed Af!ric.~ltural Buildinf!) Public lIearinf!

Janelle Szklarski, Zoning Assistant, stated that the applicant is
requesting a conditional use permit to construct all, 160 sq. ft.
metal-skinned detached accessory building on her property located at
20842 Concord Street. She indicated
that because of the cold weather in the winter and bugs in the summer
it is impossible to work and train her horses outside. She stated that
she felt she met the standards as far as the 300 ft. setback from any
neighboring dwelling and also because the building would be on 20
acres. Ms. Ostien stated that she has talked to all her neighbors
regarding this request and they do not have a problem with it.

Ned McCarty of 328 Egert Boulevard, Coon Rapids, stated that he owned
property in the area and was concerned with the size and aesthetics of
the building. He further stated that he had a buyer for part of his
property and he was also concerned with the size of the building in a
residential area.

Marilyn Van Patten stated that she was trying to sell a lot located
next to property that has horses and was having difficulty selling the
property because of the horses.

The Planning Commission was concerned with the future use of the
building if the property was sold.
