THAT ALL EXISTING BUILDINGS THAT WERE REMODELED PRIOR TO BUILDING <br />PERMIT APPROVAL BE BROUGHT UP TO THE MINIMUM STANDARDS OF THE 1988 <br />UNIFORM BUILDING CODE. <br /> <br />10. THAT THE APPLICANT VERIFY THAT THE INCREASED FLOW TO THE SOUTH <br />WILL NOT ADVERSELY AFFECT THIS AREA AND THAT A LARGER PVC PIPE TO <br />DISCHARGE OVERFLOW FROM THE SOUTH POND BE USED. <br /> <br />11. THAT THE APPLICANT PROVIDE A 24 FOOT WIDE PAVED DRIVEWAY WITHIN <br />THE ROAD EASEMENT AREA. <br /> <br />COMMISSIONER TVEITE SECONDED THE MOTION. <br /> <br />Acting Chair Johnson stated that she did not feel the applicant should <br />be able to display trailers on a grass area as the Code should be <br />enforced consistently. Janelle Szklarski stated that she will check <br />with the City Attorney as to whether the City can place any <br />stipulations on the use of the private easement for storage or display. <br /> <br />THE MOTION CARRIED 5-0. <br /> <br />Acting Chair Johnson stated that regardless of whether this conditional <br />use permit is approved, she felt that the issue of parking on the site <br />should be addressed as she feels it is an unsafe situation. <br /> <br />9. <br /> <br />Consider Conditional Use Permit/Elk River Machine/Public Hearing <br /> <br />Steve Rohlf, Building and Zoning Administrator introduced this item by <br />stating that the applicant is requesting to build a 26,250 square foot <br />addition to an existing building located in the 11 zoning district. He <br />stated this item requires a conditional use permit because it is an <br />amendment to an existing conditional use permit which allowed multiple <br />principal structures on one lot. In addition, the applicant is <br />requesting that they be allowed to combine another lot with this parcel <br />which would add another building to the same lot. Mr. Rohlf stated <br />that the applicant is proposing to add parking to accommodate the <br />potential new employees of the proposed addition. He stated that staff <br />is recommending approval of the conditional use permit. <br /> <br />Acting Chair Johnson opened the public hearing. <br /> <br />Larry Ebert, Elk River Machine, stated that they are not changing the <br />use of the property, rather they are just enlarging their current use. <br />He stated that the proposed addition would add employees and would also <br />improve the view from the park as there would be trees planted and the <br />outside storage would be relocated. <br /> <br />There being no further comments from the public, Acting Chair Johnson <br />closed the public hearing. <br />
