Consider Ordinance Amendment to Section 720 (Mineral Excavation) and <br />Section 900.31 (Excavation, Grading, and Filling)/P.H. <br /> <br />Janelle Szklarski, Zoning Assistant, stated that two ordinance <br />amendments were proposed. Section 900.31 will regulate excavation, <br />grading and filling activities in which the material remains on site. <br /> <br />Chairman Nadeau opened the public hearing. There being no one for or <br />against the matter, Chairman Nadeau closed the public hearing. <br /> <br />commissioner Minton felt that "incidental excavation",was not clearly <br />defined. After discussing this point, the Commission concurred that <br />some discretion by staff would be needed to interpret this section of <br />the ordinance. However, they did not feel that the wording needed to <br />be changed. Commissioner Minton that the "et seq." notation on the <br />last page of the ordinance was not appropriate usage of this term. <br /> <br />Ms. Szklarski explained that the intent of this section was to subject <br />all excavation, grading, and filling activities to the requirements of <br />the 1991 Wetland Conservation Act and future amendments to the Act. <br /> <br />Peter Beck, City Attorney, stated that he had reviewed the proposed the <br />ordinance amendment and recommended no changes to it. <br /> <br />COMMISSIONER MINTON MOVED TO <br />AN ORDINANCE AMENDMENT TO <br />AND FILLING" WITH REMOVAL OF <br />AMENDMENTS TO THIS ACT." <br />THE MOTION CARRIED 7-0. <br /> <br />RECOMMEND TO THE CITY COUNCIL APPROVAL OF <br />SECTION 900.31 TITLED "EXCAVATION, GRADING <br />"ET SEQ." AND ADDITION OF "AND FUTURE <br />COMMISSIONER EBERLEY SECONDED THE MOTION. <br /> <br />Ms. Szklarski stated that the second ordinance amendment involves <br />Section 720 titled "Mineral Extraction." This ordinance would regulate <br />mineral extraction activities which involved the removal of material <br />from the site. Ms. Szklarski noted that the City Council at their <br />August 17, 1992 meeting recommended that the definition of "ongoing" be <br />extended from 180 days as proposed by staff, to two years. <br /> <br />Chairman Nadeau opened the public hearing. There being no one for or <br />against the matter, Chairman Nadeau closed the public hearing. <br />
