<br />Commissioner Eberley requested staff include the address of the subject property
<br />on all future reports to the Planning Commission. This will aid the Commission
<br />when physically reviewing subject properties.

<br />Staff report presented by Steve Ach. Jeff Mastley requested a variance to the
<br />minimum lot area requirement of ten (10) acres in the A 1 zoning district. Further,
<br />Mr. Ach stated that one additional finding be made part of the record for this
<br />request:

<br />6. This request is not a consequence of the petitioner's actions.
<br />
<br />Mr. Mastley addressed the Planning Commission and stated that precedent has
<br />been set in this area regarding lots with an average size slightly less than the
<br />required ten (10) acre minimum.

<br />Chairman Tveite opened the public hearing.
<br />
<br />Roxie Brown, 10030-215th Avenue, Elk River, stated her concerns regarding tree
<br />preservation and asked the Commission to explain the City's tree preservation
<br />policy. Chairman Tveite responded. Also, Ms. Brown stated that it is very difficult
<br />for the public to hear the comments made by the Commission and staff.

<br />COMMISSIONER EBERLEY RECOMMENDED APPROVAL OF THE VARIANCE TO THE
<br />MINIMUM LOT AREA REQUIREMENT BY JEFF MASTLEY, PUBLIC HEARING, CASE NO. V
<br />94-03, CITING STAFF'S MEMO AS FINDING OF FACT. COMMISSIONER MINTON
<br />SECONDED THE MOTION. THE MOTION CARRIED 4-0.

<br />Steve Ach requested the Planning Commission review agenda items 14 and 15 together.
<br />Chairman Tveite agreed.

<br />Staff reports presented by Steve Ach. The City of Elk River requested a
<br />Comprehensive Land Use Plan Amendment changing the land use from L 1 (Light
<br />Industrial) and HR (High Density Residential) to MR (Medium Density Residential.
<br />Also, Rose Karn requested rezoning approximately five (5) acres from 11 (Light
<br />Industrial) to R3(Townhouse/ Multi Family Residential).
<br />
<br />Rose Karn, 1870 Meadowvale, Elk River, addressed the Planning Commission
<br />regarding the pending sale of her home and the delays regarding the zoning.
<br />
<br />Chairman Tveite opened the public hearing. There being no comments from the
<br />public, Chairman Tveite closed the public hearing.
<br />
<br />Commissioner Eberley asked staff to clarify this rezoning request versus agenda
<br />item 7. Mr. Ach responded.
