Jerry Smith is requesting a rezoning of property <br />located at 907 Main Street from C2 (Office District) to Cl (Central Commercial)to <br />allow uses such as restaurants, consignment shops, craft shops, and other types of <br />retail sales. <br /> <br />Chair Anderson opened the public hearing. <br /> <br />Jerry Smith, applicant and co-owner of the property, explained problems they are <br />experiencing in selling the property due to the current zoning. He felt the zone <br />change is appropriate since the downtown is moving toward service-oriented <br />businesses and small shops. Mr. Smith noted the adjacent property owner to the <br />south has indicated a concern with debris from the site and he is not sure where it <br />is coming from. <br /> <br />There being no further public comment, Chair Anderson closed the public <br />hearing. <br /> <br />Commissioner Sullivan questioned whether the site has adequate on-site and <br />street parking. Steve Ach indicated there may not be enough on-site parking if a <br />restaurant were to occupy the site, but the on-street parking could be utilized. <br /> <br />Commissioner Kuester expressed her concern for buffering the site from the <br />neighboring property, and adequate lighting be provided. Mr. Smith stated an <br />existing row of mature lilacs serves as a buffer, and there is a security light on the <br />back of the building. <br /> <br />COMMISSIONER SULLIVAN MOVED THE PLANNING COMMISSION RECOMMEND <br />APPROVAL OF ORDINANCE 97-_, REZONING PROPERTY AT 907 MAIN STREET FROM <br />C2 (OFFICE DISTRICT) TO Cl (CENTRAL COMMERCIAL)AS REQUESTED BY JERRY <br />SMITH, PUBLIC HEARING CASE NO. ZC 97-7, BASED ON THE FOLLOWING FINDINGS: <br /> <br />1. THE REZONING IS CONSISTENT WITH THE COMPREHENSIVE LAND USE PLAND <br />DESIGNATION OF CB (CENTRAL BUSINESS). <br /> <br />2. THE REZONING IS CONSISTENT WITH THE ADJACENT LAND USE DESIGNATION <br />AND ZONING DISTRICTS ON THE NORTH, EAST AND WEST. <br /> <br />3. THE PROPOSED REZONING IS A LOGICAL EXTENSION OF THE EXISTING Cl <br />ZONING DISTRICT TO THE EAST. <br /> <br />4. THE TIMES AND CONDITIONS HAVE CHANGED IN THAT THE PROPERTY HAS <br />BEEN FOR SALE FOR OVER 2 YEARS AND INTERESTED PARTIES HAVE INCLUDED <br />USES THAT ARE ALLOWED IN THE Cl DISTRICT, BUT NOT IN THE C2 DISTRICT. <br /> <br />COMMISSIONER MESICH SECONDED THE MOTION. THE MOTION CARRIED 7-0. <br /> <br />
