Planning Commission Minutes <br />Page 2 <br /> <br />June 28, 2005 <br />--------------------------- <br /> Commissioner Stevens asked what was the setback for the pond in relationship to the <br />buildings. Mr. Harlicker stated that the setback is 25 – 30 feet. Commissioner Stevens asked <br />if a larger setback will be required. Mr. Harlicker stated that it is a drainage pond, not a <br />wetland. <br /> <br /> Commissioner Westgaard asked if the plat will be impacted by the expansion of County <br />Road 12 out to the County line. Mr. Harlicker stated that the necessary right-of-way was <br />acquired when the plat for Kliever Lake Fields was approved. <br /> <br /> Chair Anderson asked if the lot in the lot along County Road 12 encroaches into the 50’ <br />setback. Mr. Harlicker stated that the lot extends into the setback slightly, but not the unit <br />itself. <br /> <br /> Chair Anderson opened the public hearing. <br /> <br /> Horst Graser, representing Tim Pomerleau – Stated that the townhome setbacks vary <br />from 25 – 30 feet from the drainage pond. He stated that they have no problem with any of <br />the recommendations proposed by staff. <br /> <br /> There being no further public comment, Chair Anderson closed the public hearing. <br /> <br /> Chair Anderson asked if there were any issues in locating a private street close to a private <br />drive. Mr. Harlicker stated that staff did not see that as an issue. Chair Anderson asked if <br />the eastern portion of Street A was too close to Fillmore. Mr. Harlicker stated no, and that <br />the overall layout of the site is similar to what was approved in the preliminary plat for <br />Kliever Lake Fields East, and that reason the lot configuration is different is because a <br />different style of townhome is being proposed. Chair Anderson asked if staff felt there <br />might be a traffic issue on Fillmore. Mr. Harlicker stated that 179 and 180 Avenues have <br />thth <br />already been constructed. <br /> <br /> Commissioner Offerman stated that the site plan does not show a sidewalk on Street A and <br />asked if one would be installed. Mr. Harlicker stated that a 6-foot sidewalk will be installed <br />on the north and east side of Street A per City Engineer Terry Maurer’s recommendation. <br />He noted that the sidewalk section detail is shown on Sheet 3 – Grading Plan. <br /> <br /> Commissioner Offerman questioned the location of the garages. Mr. Harlicker stated that <br />the designs submitted by the developer meet the R3 Townhome District standards. <br /> <br /> Commissioner Scott asked if the developer agreement addresses maintenance of the storm <br />water system. Mr. Harlicker stated yes, that part of the maintenance will be done by the City <br />and the remaining part will be the responsibility of the homeowner’s association. <br /> <br /> MOTION BY COMMISSIONER WESTGAARD AND SECONDED BY <br />COMMISSIONER LEMKE TO RECOMMEND APPROVAL OF THE REQUEST <br />BY TIM POMERLEAU FOR PRELIMINARY PLAT OF KLIEVER LAKE <br />FIELDS 3 ADDITION, WITH THE FOLLOWING CONDITIONS: <br />RD <br /> <br /> <br />1.A DEVELOPERS AGREEMENT BE PREPARED AND EXECUTED <br />OUTLINING THE TERMS AND CONDITIONS OF THE PLAT <br />APPROVAL PRIOR TO RELEASING THE PLAT FOR RECORDING. <br /> <br /> <br />
