Subject to the terms and conditions set forth herein, the City of Elk River hereby grants a conditional <br />use permit ("Permit' requested by Knife River Corporation — North Central for the following use: <br />Conditional Use Permit for Mineral Extraction Operations at 11602 225th Avenue NW <br />Property. The Permit is for the following described property ("Subject Property' in the City of Elk River, <br />Sherburne County, Minnesota: <br />cc <br />That part of the East Half of the Southwest Quarter (E 1/2 SW '/4) lying East of US Highway 169 in <br />m Section Three (3), Township Thirty-three (33), Range Twenty-six (26), Sherburne County, <br />Q Minnesota, less and except that part of the Northeast Quarter of the Southwest Quarter (NE'/4 SW <br />'/4) of Section Three (3), Township Thirty-three (33), Range Twenty-six (26), East of the Highway <br />No.169 and North of the center line of township road, according to the United States Government <br />Survey thereof and situate in Sherburne County, Minnesota. <br />Owner. Owner of the Subject Property at time of the approval of the Permit: <br />Knife River Corporation -North Central <br />Conditions. The Permit is issued subject to the following conditions: <br />1. Installation of a cattle grid device at the entrance/exit. <br />2. Staff approval of a maintenance agreement addressing street sweeping and <br />concerns with maintenance of the public street. <br />3. Maintain yearly gravel mining license. <br />4. Follow all conditions of approval outlined in CU 09-14 and CU 97-02. <br />Termination of Permit. The Permit shall remain in effect only for so long as the conditions set for the herein <br />are complied with. The City may revoke the Permit following a public hearing for violation of the terms and/or <br />conditions set forth in the Permit. <br />
