MnDOT Contract No.: 1046508 <br />STATE OF MINNESOTA <br />DEPARTMENT OF TRANSPORTATION <br />And <br />CITY OF ELK RIVER <br />COOPERATIVE CONSTRUCTION <br />AGREEMENT <br />State Project Number (S.P.): <br />7106-87 Estimated Amount Receivable <br />Trunk Highway Number (T.H.): <br />169=018 $1,507,570.10 <br />State Project Number (S.P.): <br />8608-34 <br />Trunk Highway Number (T.H.): <br />101=187 <br />State Project Number (S.P.): <br />7102-142 <br />State Project Number (S.P.): <br />7101-67 <br />Trunk Highway Number (T.H.): <br />10=003 <br />Lighting System Feed Point No's: <br />R71J,R71K,R71L,R71N <br />Signal Systems "A"-"H" ID No's: <br />4174614, 1735942, <br />4174615,1736266,4174616,1735970,4174617,22159 <br />This Agreement is between the State of Minnesota, acting through its Commissioner of Transportation ("State") and <br />the City of Elk River acting through its City Council ("City"). <br />Recitals <br />The State will perform grading, bituminous and concrete paving, retaining walls, noise wall, lighting, signals, <br />TMS, ADA improvements, Bridge No. 71001, No. 71016, No. 71017, No. 71018, No. 71019, No. 71020 <br />construction and other associated construction upon, along, and adjacent to Trunk Highway No. 169 from <br />Mississippi River to 0.35 miles north of 197t" Avenue; and on Trunk Highway No. 101 from 0.22 miles south <br />of Mississippi River to Mississippi River; and on Trunk highway No. 10 from 0.45 miles west of TH 169 to 0.39 <br />miles east of TH 169 according to State -prepared plans, specifications, and special provisions designated by <br />the State as State Project No. 7106-87 (T.H. 169=018), No. 8608-34 (TH 101=187), No. 7102-142 and <br />No. 7101-67 (TH 10=003) ("Project"); and <br />2. The City has requested the State include in its Project aesthetic elements, sanitary sewer, and signal system <br />construction; and <br />3. The City requests that it perform certain aspects of the construction engineering in connection with the <br />sanitary sewer construction and the State concurs in that request; and <br />4. The City wishes to participate in the costs of the aesthetic elements, sanitary sewer, and signal system <br />construction and associated construction engineering; and <br />5. An exception to the State's cost participation policy has been accepted by the State for the City's cost <br />participation in the new interchanges and signals; and <br />6. Agreement No. 1046509 between the State and Elk River Municipal Utilities will address watermain <br />construction; and <br />7. Agreement No. 1048143 between the State and the BNSF Railroad will address Railroad Flagging; and <br />8. A separate agreement between the State and City will address the detour on the Project; and <br />-1- <br />Receivable Standard CE by Both Parties with Signal (Cooperative Agreements) <br />
