<br />the standards, criteria, rules and re~lations of the Minnesota <br />Department of Health and Minnesota Pollution Control Agency. <br /> <br />3.4 AGRICULTURAL WASTE DISPOSAL <br /> <br />Any agricultural waste disposal operations in shoreland areas must conform <br />to the standards, criteria, rules and regulations of the Minnesota Pollution <br />Control Agency. <br /> <br />4.0 Administration of Shoreland Overlay District. (note: these administrative <br />procedures are in addition to'those of the Ci~y of Elk River Zoning Ordinance.) <br /> <br />4.1 Notification <br /> <br />a. Copies of all notices of any public hearing to consider variances, <br />amendments, conditional uses, or inconsistent plats in shoreland areas <br />shall be received by the Commissioner at least 10 days prior to such <br />hearings. <br /> <br />b. Copies of all final decisions granting variances, amendments, <br />conditional uses, or inconsistent plats and copies of all plats in <br />shoreland areas shall be received by the Commissioner within 10 days <br />of the final action. <br /> <br />4.2 Permits <br /> <br />a. Permits from the zoning administrator are required for bUilding <br />construction, installation of sewer and water facilities and. grading <br />and filling in shore land areas. <br /> <br />4.31 The grant of a variance within the shore land districts requires the <br />presence of the following conditions: <br /> <br />a. The strict enforcement of the land use controls will result in <br />unnecessary hardship. <br /> <br />b. Granting of the variance is not contrary to the purpose and intent <br />of the zoning provision herein established by these standards and <br />criteria. <br /> <br />c. There are exceptional circumstances unique to the subject property <br />which were not created by the landowners. <br /> <br />d. Granting of the variance will not alter the essential character of <br />locality. <br /> <br />4.4 Nonconforming Uses, Substandard Uses <br /> <br />4.41 Nonconforming Uses. Uses which are prohibited by this ordinance <br />but which are in existence prior to the effective date of this ordinance <br />shall be non-conforming uses. Such uses shall hot be intenSified, <br />enlarged, or expanded beyond the permitted or delineated boundaries of <br />use or activity as stipulated in most current permit issued prior to the <br />adoption of this ordinance. <br /> <br />16. <br />
