u <br />City of Elk River <br />City Council <br />Resolution 21-95 <br />A Resolution of the City Council of the City of Elk River Authorizing <br />Submission of a Minnesota Capital Grant Application <br />WHEREAS, the Rolling Hills Subdivision ("Subdivision"), located within the City of Elk <br />River ("City"), currently has a community Subsurface Sewage Treatment System ("SSTS") <br />serving 28 properties in the Subdivision; and <br />WHEREAS, the SSTS has failed and requires replacement in order to serve the 28 <br />properties within the Subdivision and protect ground water in the area; and <br />WHEREAS, the most cost-effective solution to replace the SSTS appears to be to connect <br />the Subdivision to the City Waste Water Treatment Plant ("WWTP"); and <br />WHEREAS, the WWTP has the capacity to serve the Subdivision; and <br />WHEREAS, the cost of connecting the Subdivision to the WWIP is estimated to be <br />approximately $93,000 for each of the 28 homes within the Subdivision; and <br />WHEREAS, the City will likely not be able to assess, and many of the properties within <br />the Subdivision will not be able to pay, $93,000 per lot; and <br />WHEREAS, the Rolling Hills Homeowners Association ("HOA:") has proposed that the <br />City seek a Capital Grant ("Grant") to assist in the costs of connecting the Subdivision to <br />the WWTP; and <br />WHEREAS, the City is willing to apply for the Grant provided that the properties within <br />the Subdivision pay, by special assessment otherwise, all costs not covered by the Grant for <br />connecting the Subdivision to the WWTP; and <br />WHEREAS, the City has the legal authority to receive financial assistance, and the <br />institutional, managerial, and financial capability to ensure adequate project administration; <br />and <br />WHEREAS, the local match identified in the Grant application will be paid by the <br />properties within the Subdivision; and <br />VAMUREJ <br />
