Any person who violates this ordinance or fails to <br />.complY with any of its requirements shall upon conviction thereof be fined not more <br />than Five Hundred Dollars ($500) or imprisoned for not more than ninety (90) days, or <br />both, and in addition shall pay all costs and expenses involved in the case. Each day <br />such violation continues shall be considered a separate offense. Nothing herein <br />contained, including the imposition of a crilninal penalty, shall constitute a waiver <br />of the right of the City or others to secure abatement of violations by injunction or <br />other civil legal remedy. . <br /> <br />. <br />902.58 - Amendments. The floodplain designation on the official maps described <br />in this ordinance shall not be removed from floodplain areas unless it can be shown <br />that the designation is in error. Special exceptions to this rule may be permitted <br />by the Commissioner of Natural Resources if he determines that, through other measures, <br />lands are adequately protected for the intended use. <br /> <br />All amendments to this ordinance including amendments to the official maps herein <br />described must be submitted to and approved by the Commissioner of ~;atural Resources <br />prior to adoption. Changes in the official maps also require prior approval by the <br />Federal Insurance Administration. <br /> <br />Section 904 - Shoreland and Wild and Scenic River Ma!:a~eTIl~nt .Ord.inanc~_ <br /> <br />904.00 - Purpose and Authorization. The purpose of this ordinance is to regulate <br />development within shoreland areas and within the l1ississippi Wild. Scenic and <br />Recreational River System as required by Minnesota Statutes, Sections 104.31-104.40, <br />105.485, and 462.351-462.364. <br /> <br />. <br /> <br />904.02 - Scope and Interpretation. <br /> <br />1. The provisions of this ordinance shall apply wi thin :uunicipal shoreland areas <br />as defined by Minnesota Regulations NR S2(d) and within the designated Recreational <br />. River Land Use District of the Mississippi \>1ild, Scenic and Recreational River <br />System in accordance with the property descriptions of Minnesota Regulations NR <br />2400. <br /> <br />2. The provisions of this ordinance shall be interpreted to be minimum <br />requirements. The provisions of any other ordinance which impose greater <br />restrictions or provisions not addressed by this ordinance shall apply within the <br />lands controlled by this ordinance. <br /> <br />904.04 - General Provisions. All applicable ~inimum standards set forth in <br />Minnesota Regulations NR 82-~NR 2420 C.6., and ~~ 2420 C.8. are hereby adopted by <br />reference and made a part hereof as fully as if set forth herein. Copies of these <br />regulations shall be kept on file in the office of the Clerk-Administrator. <br /> <br />904.06 - Shoreland Classifications. <br /> <br />. <br /> <br />1. The following lakes are hereby classified "Natural Environment" (NE) in <br />accordance with Minnesota Regulations NR 82(f): ~win Lake; Kliever Marsh (located <br />in Sections 1 & 2, T 32N, R 26W); Eagle Lake; Rice Lake; Unnamed Lake (located <br />in Section 2. T 33N. R 26W); Unnamed Lake (located in Section 12, T 33N, R 26W); <br />Unnamed Lake (located in Sections 12 & 13, T 33N, R 26W); Unnamed Lake (located <br />in SE 1/4 of Section 23, T 33N, R 26W); Unnamed Lake (located in SW 1/4 of Section <br />23, T 33N, R 26W); Unnamed Lake (located in Sections 16 and 17.
