<br />902.40 - Effect of Permit A roval Under Othe~!rovisions of the Zoning Ordinance. <br />.The granting 0 any permit un er other provislolls of the Zoning Ordinance shall not <br />mply the approval of any work or use of land or watar within the Floodway or Flood <br />Fringe Districts. Where specifically required by this ordinance, such approval may <br />be expressly given in conjunction with other permits applied for, but no approval. shall <br />be implied from the grant of such permits nor froiu the necessity to apply for a permit <br />as described herein. <br /> <br />902.42 - Effect of Permit Approval Under This QEdina~. The granting of a permit <br />under the provisions of this ordinance shall in no way affect the owner's responsibility <br />to obtain the approval required by any other statute, ordinance or regulation of any <br />state agency or subdivision thereof. <br /> <br />902.44 - Certificate of Zoning Compllanc~"for New or Altere~.~. It shall be <br />unlawful to use, occupy, or permit the use or occupancy of any building or premises, <br />or both, or part thereof hereafter created, erected, changed, converted, or wholly or <br />partly altered or enlarged in its use or structure until a certificate of zoning <br />compliance shall have been issued therefor by the Zon.ing and Building Administrator <br />stating that the use of the building or land conforms to the requirements of this <br />ordinance. Where a nonconforming use or structure is extended or substantially altered, <br />the certificate of zoning compliance shall specifically state the manner in which the <br />nonconforming structure or use differs from the provisions of this ordinance. <br /> <br />902.46 - Construction and Use to Be as Provided in Approved Plans and Applications. <br />Use permits, conditional use permits, or certificates of zoning compliance issued on <br />the basis of approved plans and applications authorize only the use, arrangement, and <br />.construction set forth in such approved plans and applications, and no other use, <br />arrangement, or construction. Any use, arrangelnentt or construction at variance with <br />that authorized shall be deemed a violation of tllis ordinance and punishable as provided <br />herein. The applicant may be required to submit certification by a registered <br />professional engineer, registered architect, or re.gistered land surveyor that the <br />finished fill and building elevations were accomplished in compliance with the provisions <br />of this ordinance. Floodproofing measures, where permitted, shall be certified by a <br />registered professional engineer or registered architect. <br /> <br />902.48 - Record of First Floor Elevation. The Zoning and Building Administrator <br />shall maintain a record of the elevation of the first floor (including basement) of <br />all new structures or additions to existing structures in the floodplain districts. <br />He shall also maintain a record of the elevations to which structures or additloas to <br />structures are floodproofed. <br /> <br />902.50 - Board of Adjustment. <br /> <br />1. The City Council, which serves as the Board of Adjustment under the Zoning <br />Ordinance of the City of Elk River pursuant to Section 900.40 of this Code, shall <br />be the Board of Adjustment under this ordinance with the following powers and <br />duties: <br /> <br />a. To bear and decide appeals where it is alleged that there 1s an error <br />in any order, requirement, decision, or determination made by the Zoning and <br />Building Administrator in the administration of this ordinance. <br /> <br />. <br /> <br />b. To hear and decide requests for variances from the provisions of this <br />ordinance pursuant to the standards set forth in Section 902.52 hereof. <br /> <br />12. <br />
