Preliminary Plat. <br /> <br />i. After the pre-application meeting, the subdivider or owner shall <br />file with the City Clerk fifteen (15) copies of a preliminary plat. <br />The preliminary plat shall be accompanied by proof of ownership (abstract, <br />title insurance policy, registered property abstract and any unrecorded <br />documents) satisfactory to the City Attorney. All plats and subdivisions <br />presented to the City Clerk for approval by the Planning Commission and <br />City Council shall be accompanied by a filing fee established by <br />resolution of the City Council. <br /> <br />Rejection of the plat or subdivision by the City Council, or abandonment <br />or withdrawal of the proposed plat or subdivision by the subdivider, <br />shall not entitle the person or persons who paid the fee to the return <br />of all or any part thereof. <br /> <br />. <br /> <br />ii. If the proposed subdivision abuts on a county right-of-way, the <br />City Clerk may refer one (1) copy of the preliminary plat to the County <br />Engineer, one (1) copy to the City Engineer and two (2) copies to the <br />City Planning Commission for their review and report. The subdivider <br />shall obtain a certificate from the County Engineer stating that the <br />subdivision complies with county standards relating to street access, <br />driveway access and right-of-way reservation. Plats abutting county <br />rights-of-way shall not be approved without county certification. A <br />similar procedure shall be followed with the State Department of <br />Transportation if the proposed subdivision abuts a roadway under the <br />jurisdiction of the State of Minnesota. The County Engineer shall approve <br />or deny certification twenty (20) days after the date of receipt of the <br />plat. The City Engineer shall report to the City Planning Commission <br />within twenty (20) days after the date of receipt of the preliminary <br />plat. <br /> <br />If the proposed subdivision does not abut on a county right-of-way, the <br />City Clerk may refer one (1) copy of the preliminary plat to the City <br />Engineer, and two (2) copies to the City Planning Commission. The <br />Engineer shall report to the Planning Commission twenty (20) days after <br />the date of receipt of the plat. <br /> <br />. <br /> <br />iii. Within thirty (30) days after the preliminary plat is filed with <br />the City Clerk and after reports and certifications required in Section <br />l008.08(1)(b)(i), (ii) and after a report from the City Administrator <br />or his designee have been received as requested, the City Planning <br />Commission shall hold a public hearing on the preliminary plat after <br />notice of the date, time, place and purpose of the hearing has been <br />published once in the official newspaper at least ten (10) days before <br />the date of hearing. The Planning Commission may, in its discretion, <br />refer one (1) copy of the preliminary plat to utilities, school districts <br />and affected metropolitan, county, regional, special district or state <br />agencies for review and comment. The referral letter shall state that <br />comments or recommendations must be submitted to the City within twenty <br />(20) days after the date of referral.
