<br /> <br />~Sect1on 902 - Floodplain Management Ordinance <br /> <br />902.00 - Statutory Authorization. Pursuant to the National Flood Insurance Act <br />of 1968, the legislature of the State of Minnesota has in Minnesota Statutes 1969, <br />Chapters 104 and 462, delegated the responsibility to local goverrunental units to adopt <br />regulations designed to m1n~1ze flood losses. Therefore, the City Council of the City <br />of Elk River, Minnesota, does ordain as follows: <br /> <br />. <br />902.02 - Findings of Fact. <br /> <br />1. Flood Hazard Area Losses. The flood hazard areas of the City of Elk River, <br />Minnesota, are subject to periodic inundation which may result in 1086 of life, <br />108s of property, health and safety hazards, disruption or commerce and governmental <br />services, extraordinary public expenditures for flood protection and relief, and <br />impairment of the tax base, all of which adversely affect the public health, safety <br />and general welfare. <br /> <br />2. Methods Used to Analyze Flood Hazar~. This ordinance is based upon a <br />reasonable method of analyzing flood hazards which is consistent with the standards <br />established by the Minnesota Department of Natural Resources. <br /> <br />902.04 - Statement of Purpose. It is the purpose of this ordinance to promote <br />the public health, safety and general welfare and to minimize those losses described <br />in Section 902.02(1) by provisions contained herein. <br /> <br />~ <br /> <br />902.06 - Abrogation and Greater Restrictions. It is not intended by this ordinance <br />to repeal, abrogate or impair any existing easements, covenants, deed restrictions, <br />or ordinances. However, where this ordinance imposes greater restrictions, the <br />provisions of this ordinance shall prevail. <br /> <br />902.08 - Interpretation. In their interpretation and application, the provisions <br />of this ordinance shall be held to be minimum requirements and shall be liberally <br />construed in favor of the governing body. They shall not be deemed a limitation or <br />repeal of any other powers granted by laws or regulations of the State of Minnesota <br />or local ordinances. <br /> <br />902.10 - Warning and Disclaimer of Liability. This ordinance does not Imply that <br />areas outside the floodplain districts or land uses permitted within such districts <br />will be free from flooding or flood damages. This ordinance shall not create liability <br />on the part of the City or any officer or employee thereof for any flood damages that <br />result from reliance on this ordinance or any administrative decision lawfully made <br />thereunder. <br /> <br />902.12 - Separability. Every section, provision or part of this ordinance is <br />declared separable from every other section, provision or part; and if any section, <br />provision or part thereof shall be held invalid, it shall not affect any other section, <br />provision or part. <br /> <br />902.14 - Definitions. Unless specifically defined below, words or phrases used <br />in this ordinance shall be interpreted so as to give them the same meaning as they have <br />~ in common usage and so as to give this ordinance its most reasonable application. <br /> <br />1. "Accessory Use or Structure" shall mean a use or structure on the same lot <br />
