<br />. <br /> <br />(d) Intentionally or negligently provides to <br />the City any inaccurate information, <br />report, notification, or other item <br />required to be provided by this ordinance <br />or any license issued hereunder; or <br /> <br />(e) Permits a violation of this ordinance to <br />exist on premises under their control; or <br /> <br />(f) Fails to notify the City immediately of any <br />violation of this ordinance which exists at <br />a facility licensed pursuant to this <br />ordinance. <br /> <br />2. Misdemeanor. Any person within the City of Elk <br />River who violates this Ordinance, or who shall <br />permit such a violation to exist on premises <br />under their control, or who shall fail to take <br />action to abate the existence of a violation <br />within a specified time period when ordered or <br />notified to do so by the City, shall be guilty <br />of a misdemeanor, and upon conviction thereof <br />shall be punished therefor, as provided by law. <br />A separate offense shall be deemed committed <br />upon each day during or on which a violation <br />occurs or continues. <br /> <br />. <br /> <br />3. <br /> <br />. <br /> <br />Equitable Relief. In the event of a violation <br />or threat of violation of this Ordinance, the <br />City may, in addition to any other action taken, <br />take appropriate action to enforce this <br />Ordinance, including application for injunctive <br />relief, action to compel performance, or other <br />appropriate action of the court, if necessary, <br />to prevent, restrain, correct, or abate such <br />violations or threatened violations. <br /> <br />4. citations. The City may issue citations for a <br />violation of this Ordinance whenever any <br />representative of the City discovers a violation <br />of this Ordinance. The citation shall be issued <br />to the person charged with the violation, or in <br />the case of a corporation, any officer or agent <br />expressly or impliedly authorized to accept such <br />issuance. <br /> <br />5. <br /> <br />Enforcement Costs. If a person fails to comply <br />with the provisions of this Ordinance, the <br />City's costs incurred for corrective action, <br />including attorneys' fees and other costs of <br />recovery, may be recovered in a civil action in <br />any court of competent jurisdiction or, at the <br />discretion of the City Council, these costs may <br />be included in the annual license fee for the <br />facility as provided in Section 604.08(2) of <br />this Ordinance. <br />43. <br />
