<br />. <br /> <br />B. A new Section 604 1S hereby added to the City Code, <br />as follows: <br /> <br />"Section 604 - Solid Waste Facilities. <br /> <br />604.00 - Purpose. The purpose of this Solid Waste <br />Facility Ordinance is to protect the public health, <br />safety, and general welfare by establishing standards <br />for and regulating the operation of Solid Waste <br />Facilities in the City of Elk River, requiring <br />licenses for the establishment and operation of Solid <br />Waste Facilities, by requiring a performance bond and <br />by establishing penalties for lack of compliance with <br />the provisions of this ordinance. <br /> <br />604.02 - Definitions. Unless the context clearly <br />indicates otherwise, the words, combination of words, <br />terms, or phrases used in this Section 604.00, et <br />~, shall have the meanings set forth below: <br /> <br />. <br /> <br />. <br /> <br />1. <br /> <br />"Solid Waste" shall mean garbage, refuse, sludge <br />from a water supply treatment plant or air <br />containment treatment facility, construction and <br />demolition debris, and other discarded waste <br />materials and sludges, in solid, semi-solid, <br />liquid, or contained gaseous form, resulting <br />from residential, industrial, commercial, <br />mining, and agricultural operations, and from <br />community activities. The term "Solid Waste" <br />shall include Solid Waste which has been <br />processed in a Solid Waste Processing Facility, <br />but shall not include Hazardous Waste; Dangerous <br />Waste; tires; animal waste used as fertilizer; <br />earthen fill, boulders, rock; sewage sludge; <br />solid or dissolved material in domestic sewage <br />or other common pollutants in water resources, <br />such as silt, dissolved or suspended solids in <br />industrial waste water effluence or discharges <br />which are point sources subject to permits under <br />Section 402 of the Federal Water Pollution <br />Control Act, as amended; dissolved materials 1n <br />irrigation return flows; or source, special <br />nuclear, or byproduct material as defined by the <br />Atomic Energy Act of 1954, as amended. <br /> <br />2. <br /> <br />"Hazardous waste" shall mean any refuse, sludge, <br />or other waste material or combinations of <br />refuse, sludge, or other waste materials in <br />solid, semi-solid, liquid, or contained gaseous <br />form which because of its quantity, <br />concentration, or chemical, physical, or <br />infectious characteristics may: <br /> <br />4. <br />
