<br />. <br /> <br />additional requirements, if it finds the <br />plan of operation or other information <br />submitted with the application or other <br />factors make the imposition of additional <br />requirements or standards necessary to <br />protect and safeguard the public health, <br />safety, and general welfare. <br /> <br />604.30 - Solid Waste processinq Facilities. <br /> <br />1. Prohibited Areas. No Solid Waste processing <br />Facility shall be located, operated or <br />maintained in any area of the City of Elk River <br />other than those areas where Solid Waste <br />Processing Facilities are a permitted or a <br />conditional use pursuant to Chapter IX of the <br />Elk River City code, nor shall such facilities <br />be allowed to locate within: <br /> <br />(a) A regional flood plain (100 year old <br />flood); <br /> <br />(b) A wetland; <br /> <br />. <br /> <br />(c) Within 500 feet of the nearest edge of the <br />right of way of any state, federal, or <br />interstate highway or the boundary of a <br />public park or of an occupied dwelling. <br />permission may be granted to vary the <br />distance requirement of this subsection (c) <br />in the discretion of the City Council, <br />taking into consideration such factors as <br />noise, dust, litter, and other aesthetic <br />and environmental considerations; <br /> <br />(d) An area which is unsuitable because of <br />reasons relating to topography, geology, <br />hydrology, soils, air quality, or proximity <br />to wells used for potable water supply. <br /> <br />2. License Required. It is unlawful for any person <br />to construct, establish, operate, or maintain a <br />Solid Waste Processing Facility (including a <br />resource recovery facility, a waste reduction <br />facility, a refuse derived fuel facility, etc.), <br />without first being licensed to do so by the <br />City. Application for a Solid Waste Facility <br />license to operate a Solid Waste Processing <br />Facility shall be made in writing to the City <br />and delivered to the City Building and zoning <br />Administrator. The application shall contain <br />the following information: <br /> <br />. <br /> <br />(a) The name and address of the person <br />requesting the license; <br /> <br />35. <br />
