of <br />-- City of Elk River <br />Ver City Council <br />Resolution 21-59 <br />A Resolution of the City Council of the City of Elk River Adopting the Assessment <br />Roll for the Lake Orono Restoration and Enhancement (LORE) Project <br />WHEREAS, pursuant to proper notice duly given as required by law, the Elk River City Council <br />has met to consider the proposed assessment roll for the Lake Orono Restoration and <br />Enhancement (LORE) project and has heard and passed upon all objections to the proposed <br />assessment, <br />NOW THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY <br />OF ELK RIVER, MINNESOTA AS FOLLOWS: <br />1. The proposed assessment roll for the LORE project, a copy of which is attached hereto and <br />made a part hereof as Exhibit A, is hereby adopted and shall constitute a special assessment <br />against the lands named therein, and each tract of land therein included is hereby found to <br />be benefited by the LORE project in the amount of the assessment levied against it. <br />2. Such assessment shall be payable in equal annual installments extending over a period of two <br />years, as shown on the assessment roll, the first of the installments to be payable on or <br />before May 15, 2022, and shall bear interest at the rate of two percent per annum from the <br />date of the adoption of this assessment resolution. To the first installment shall be added <br />interest on the entire assessment from the date of this resolution until December 31, 2022. <br />To each subsequent installment, when due, shall be added interest for one year on all unpaid <br />installments. <br />The owner of any property so assessed may, at any time prior to certification of the <br />assessment to the county auditor, pay the whole of the assessment on such property, with <br />interest accrued to the date of payment, to the city clerk, except that no interest shall be <br />charged if the entire assessment is paid within 30 days from the adoption of this resolution; <br />and he/she may, at any time thereafter, pay to the city clerk the entire amount of the <br />assessment remaining unpaid, with interest accrued to December 31 of the year in which <br />such payment is made. Such payment must be made before November 15 or interest will be <br />charged through December 31 of the next succeeding year. Property owners may also make <br />partial prepayment of an assessment as authorized by and subject to the provisions of <br />Section 62-2 of the City of Elk River Code of Ordinances. <br />4. Pursuant to Minn. Stat. §§ 435.193 to 435.195, and Section 62-1 of the City of Elk River <br />Code of Ordinances, the council may, in its discretion, defer the payment of this special <br />assessment for any homestead property owned by a person 65 years of age or older, one <br />retired by virtue of a permanent and total disability, or a member of the National Guard or <br />
