of -- City of Elk River Ver City Council Resolution 21-59 A Resolution of the City Council of the City of Elk River Adopting the Assessment Roll for the Lake Orono Restoration and Enhancement (LORE) Project WHEREAS, pursuant to proper notice duly given as required by law, the Elk River City Council has met to consider the proposed assessment roll for the Lake Orono Restoration and Enhancement (LORE) project and has heard and passed upon all objections to the proposed assessment, NOW THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF ELK RIVER, MINNESOTA AS FOLLOWS: 1. The proposed assessment roll for the LORE project, a copy of which is attached hereto and made a part hereof as Exhibit A, is hereby adopted and shall constitute a special assessment against the lands named therein, and each tract of land therein included is hereby found to be benefited by the LORE project in the amount of the assessment levied against it. 2. Such assessment shall be payable in equal annual installments extending over a period of two years, as shown on the assessment roll, the first of the installments to be payable on or before May 15, 2022, and shall bear interest at the rate of two percent per annum from the date of the adoption of this assessment resolution. To the first installment shall be added interest on the entire assessment from the date of this resolution until December 31, 2022. To each subsequent installment, when due, shall be added interest for one year on all unpaid installments. The owner of any property so assessed may, at any time prior to certification of the assessment to the county auditor, pay the whole of the assessment on such property, with interest accrued to the date of payment, to the city clerk, except that no interest shall be charged if the entire assessment is paid within 30 days from the adoption of this resolution; and he/she may, at any time thereafter, pay to the city clerk the entire amount of the assessment remaining unpaid, with interest accrued to December 31 of the year in which such payment is made. Such payment must be made before November 15 or interest will be charged through December 31 of the next succeeding year. Property owners may also make partial prepayment of an assessment as authorized by and subject to the provisions of Section 62-2 of the City of Elk River Code of Ordinances. 4. Pursuant to Minn. Stat. §§ 435.193 to 435.195, and Section 62-1 of the City of Elk River Code of Ordinances, the council may, in its discretion, defer the payment of this special assessment for any homestead property owned by a person 65 years of age or older, one retired by virtue of a permanent and total disability, or a member of the National Guard or
