<br />ORDINANCE NO. 84-9 <br /> <br />AN ORDINANCE, INCLUDING ADDENDUM WITH EXHIBITS, GRANTING A <br />FRANCHISE TO RITE CABLE COMPANY OF MINNESOTA, LTD. TO,OPER- <br />ATE AND MAINTAIN A CABLE COMMUNICATION SYSTEM IN THE CITY; <br />SETTING FORTH CONDITIONS ACCOMPANYING THE GRANT OF-FRAN- <br />CHISE; PROVIDING FOR REGULATION, AND USE OF THE SY~TEM; AND <br />PRESCRIBING PENALTIES FOR THE VIOLATION OF ITS PROVISIONS <br /> <br />The City Council of the City of Elk River ordains: <br /> <br />STATEMENT OF INTENT AND PURPOSE <br /> <br />The City intends, by the adoption of this Franchise, to <br />bring about the development of a Cable Communications Sys- <br /> <br />tem, and the continued operation of it. Such a development <br />can contribute significantly to the communication needs and <br /> <br />desires of many. Further, the City,may achiev~ better uti- <br /> <br />-, <br /> <br />lization and improvement of public services wit~ the devel- <br />opment and operation of a Cable Communications System. <br />Past studies, participated in by City, have led the way <br /> <br />for organizing a means of procuring and securing a Cable <br /> <br />Communications System which, in the judgement of the <br />Council, is best suited to the City. This has resulted in <br />the preparation and adoption of this Franchise. ' <br /> <br />FINDINGS <br /> <br />I~ the review of the proposal and application of Rite <br /> <br />Cable Company of Minnesota, Ltd. ("Grantee"), and as a re- <br /> <br />suIt of the public hearings, the City Council makes the <br />following findings: <br />
