<br />. <br /> <br />. <br /> <br />. <br /> <br />Elk River City Council Minutes <br />March 20, 1989 <br /> <br />Page 7 <br /> <br />8.5 Ordinance Amendment to Chapter 7 Pawnbrokers License/Public Hearing <br />Steve Rohlf, Building and Zoning Adminstrator, indicated that the staff <br />has initiated an Ordinance Amendment to Section 724 of the City <br />Ordinance. Discussion between the Council and staff took place on <br />Section 724.14 regarding redemption of articles. Steve Rohlf indicated <br />that he would feel more comfortable inserting a time period for the <br />redemption of these articles instead of leaving it up to the pawnbroker. <br />It was the consensus of the Council to delete the time agreed to by <br />pawnbrokers and himself and add 30 days to Section 724.14. <br /> <br />Mayor Tralle opened the public hearing. There being no one for or <br />against the matter, Mayor Tralle closed the public hearing. <br /> <br />COUNCILMEMBER SCHULDT MOVED TO ADOPT ORDINANCE 89-6 WITH THE AMENDMENI' <br />MADE TO SECTION 724.14, AN ORDINANCE LICENSING AND REGULATING <br />PAWNBROKERS. COUNCILMEMBER HOLMGREN SECONDED THE MOTION. THE MOTION <br />CARRIED 5-0. <br /> <br />8.6 <br /> <br />Final Plat Shores of Briarwood <br />Steve Rohlf, Building and Zoning Administrator, indicated that Ron Kuhn <br />is requesting final plat review of the plat of Shores of Briarwood. He <br />stated that the plat has been reduced to three lots to meet the City's <br />lot size standards as was required by the City Council. He indicated <br />that the Planning Commission reviewed the plat and recommended approval. <br /> <br />COUNCILMEMBER DOBEL MOVED TO APPROVE THE FINAL PLAT OF THE SHOUS or <br />BRIARWOOD WITH THE FOLLOWING STIPULATIONS: <br /> <br />1. THAT THE DEVELOPER PAY $400 IN PARK DEDICATION FEES FOR THE <br />ADDITIONAL TWO BUILDING SITES CREATED WITHIN THE PLAT. <br /> <br />2. THAT THE ROAD CONSTRUCTION WITHIN THE PLAT BE AS PER THE PLANS AND <br />SPECS APPROVED BY THE CITY ENGINEER. <br /> <br />3. THAT THE CITY ATTORNEY PREPARE A DEVELOPER'S AGREEMENI' WHICH THE <br />DEVELOPER MUST ENTER INTO PRIOR TO THE RECORDING OF THE PLAT. <br /> <br />4. THAT THE ENGINEERING DETAILS REQUIRING CITY STAFF AND BILL HARJU'S <br />APPROVAL ARE REQUIRED PRIOR TO CONSTRUCTING A DRIVEWAY TO LOT 1 <br />BLOCK 1. <br /> <br />S. THAT THE DEVELOPER HAVE A ONE YEAR COMPLETION DATE FROM THE DATE OF <br />COUNCIL FINAL PLAT APPROVAL TO COMPLETE THE IMPROVEMENTS ASSOCIATED <br />WITH THE PLAT. <br /> <br />6. THAT THE COST OF THE IMPROVEMENTS IN THE PLAT BE COVERED BY A 100% <br />LETTER OF CREDIT AND FURTHER THAT THE LETTER OF CREDIT BE MADE IN <br />THE AMOUNr OF $15,000 WHICH IS THE AMOUNT ESTIMATED BY TERRY MAURER, <br />CITY ENGINEER FOR IMPROVEMENTS WITHIN THE PLAT. <br /> <br />7. <br /> <br />THAT A 25% WARRANTY BOND BE POSTED BY THE DEVELOPER IN FAVOR OF THE <br />CITY FOR A ONE YEAR PERIOD FOLLOWING CITY ACCEPTANCE OF THE <br />IMPROVEMENTS WITHIN THE PLAT. <br />
