Landscaping <br />The proposed landscape plan shows several trees along the private streets, and between the townhomes. <br />The plan also shows the required shrubs for each townhome. Additional screening along the south <br />property line is recommended. <br />Applicable Regulations <br />Zone Change <br />In revienring a proposed amendment, consideration shall begiven to existing conditions nritb' the area directly and indirectly <br />affected by the proposal, the conservation of property values, the use to n�hich the property affected is being devoted at the time, <br />and relevant provisions, if any, in the land use plan. <br />The proposed use complies with the guidance provided in the land use plan. <br />Conditional Use Permit/PUD <br />The issuance of a Conditional Use Permit can be ordered only if the use at the proposed location: <br />1. mill not endanger, injure or detrimentally affect the use and enjoyment of otherproperty in the immediate vicinity or <br />the public health, safety, morals, comfort, convenience orgeneral uvlfare of the neighborhood or the city. <br />The residential use will not detrimentally affect the use and enjoyment of adjacent properties. <br />However, the residents of the future townhomes may be impacted by the existing commercial facility <br />directly south of the subdivision. Preservation of existing vegetation and additional landscaping are <br />recommended along the south property line to mitigate these impacts. <br />2. mill be consistent nrith the Comprehensive Plan. <br />The property is guided for mixed use where residential uses are permitted. The use will be consistent <br />with the comprehensive plan. <br />3. mill not impede the normal and orderly development and improvement of surrounding vacant property. <br />This is the last remaining undeveloped parcel in the area and the project will not impede normal <br />development of the area. <br />4. mill be served adequately by and mill not adversely affect essential public facilities and services including streets, police <br />and fire protection, drainage, refuse disposal, neater and sen er systems, parks and schools; and mill not, in particular, <br />create traffic congestion or interference nvith traffic on adjacent and neighboring public thoroughfares. <br />The use will be served adequately by and will not adversely affect essential public facilities and services <br />including streets, police and fire protection, drainage, refuse disposal, water and sewer systems, parks <br />and schools; and will not, in particular, create traffic congestion or interference with traffic on adjacent <br />and neighboring public thoroughfares. <br />5. mill not involve uses, activities, processes, materials, equipment, and conditions of operation that mill be detrimental to <br />any persons or property because of excessive traffic, noise, smoke, fumes, glare, odors, dust or vibrations. <br />The proposed residential use will not involve uses, activities, processes, materials, equipment, or <br />conditions that will be detrimental to other properties. <br />6. mill not result in the destruction, loss, or damage of a natural, scenic or historic feature of major importance. <br />The project proposes to fill an existing wetland on the east side of the site. The applicant has applied <br />for all required permits and is moving through the mandated review process. Approval of that <br />application is included as a condition of approval. <br />
