<br />e <br /> <br />e <br /> <br />e <br /> <br />ORDINANCE 90 - 14 <br /> <br />AN ORDINANCE AMENDING SECTION 1008.16 - EASEMENTS <br />SUB 1. - PROVIDED FOR UTILITIES <br /> <br />The City Council of the City of Elk River does ordain as <br />follows: <br /> <br />Se_ction 1. That Section 1008.16(1) of the Elk River <br />City Code of Ordinances titled, "Provided for Utilities" be <br />amended as follows: <br /> <br />1. <br /> <br />Provided for Utilities. Easements at least twelve <br />(12) feet wide, centered on rear and other lot lines, <br />shall be provided for utili ties where necessary; if <br />appropriate, easements of lesser width may be allowed <br />by the City, particularly easements along front lot <br />lines. They shall have continuity of alignment from <br />block to block. No fences, other structures, or <br />plantings other than grass can be placed in a utility <br />easement where it will interfere with the maintenance <br />of said utilities as determined by the Building and <br />Zoning Administrator. If removal of a fence, other <br />structure, or planting is necessitated for <br />maintenance of utilities, the cost of removal and <br />replacement is the responsibility of the affected <br />property owner. <br /> <br />Section 2.
