The proposed use could detrimentally affect the use and enjoyment of other property in the immediate <br />vicinity. <br />Please note that the required findings for an IUP are different than for a CUP and do not include the standard for <br />issuance of a CUP the Planning Commission found was not met. The required findings for an IUP are found in <br />Section 30-658 of the City Code, which is attached. Staff believes these findings are all met by this application, <br />provided the applicant agrees to the conditions approved by Council. <br />The City Council reviewed the request at their July 6, 2021, meeting and after several questions were raised <br />regarding a letter submitted from a medical professional on behalf of the applicant, requested the city attorney <br />advise whether the Americans with Disabilities Act (ADA) or Federal Fair Housing Act (FHA) require Council <br />approve the application for a CUP. The city attorney's findings are attached in a memo dated July 14, 2021. <br />The Council also discussed if the CUP could be changed to an IUP as they would be more comfortable with the <br />request knowing it would not go with the property indefinitely.
