<br />CITY OF ELK RIVER <br /> <br />RESOLUTION NO. 05-_ <br /> <br />A RESOLUTION AMENDING THE COMPREHENSIVE PLAN <br />TO CHANGE THE LAND USE FROM OS (OPEN SPACE) TO UR (URBAN <br />RESIDENTIAL) <br /> <br />Case No. LU 05-04 <br /> <br />WHEREAS, Minnesota Statutes, Chapter 462.355, Subdivision 2, prescribes the procedure <br />for amending the Comprehensive Plan, and <br /> <br />WHEREAS, the Planning Commission held a public hearing on Tuesday, August 9,2005 <br />and recommended denial regarding the Comprehensive Plan amendment request for the property <br />generally described as: <br /> <br />Outlot A and Outlot B, Pinewood Estates, <br />Sherburne County, Minnesota <br /> <br />and, <br /> <br />WHEREAS, the City Council has reviewed the Comprehensive Plan amendment request <br />and finds the following: <br /> <br />1. The proposed land use designation is consistent with the current zoning of the <br />property. <br />2. Conditions have changed to warrant a change in the use; it is not economically <br />feasible to continue to use the land as a private golf course. <br />3. The proposed land use is consistent with the proposed use of the property. <br />4. The proposed land use is compatible with adjacent land use designations. <br /> <br />NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Elk River <br />that the Land Use Plan be amended to change the property as described above from OS (Open <br />Space) to UR (Urban Residential). <br /> <br />PASSED by the City Council of the City of Elk River this 15th day of August, 2005. <br /> <br />Stephanie Klinzing, Mayor <br /> <br />ATTEST: <br /> <br />Joan Schmidt, City Clerk <br />
