<br />. <br /> <br />. <br /> <br />. <br /> <br />ORDINANCE 91 - ~ <br />AN ORDINANCE AMENDING SECTION 602.00 REFUSE AND GARBAGE <br /> <br />The City Council of the City of Elk River does ordain as <br />follows: <br /> <br />Section 1. That Section 602.00 of the City of Elk River <br />Code of Ordinances titled "Definitions" be amended to add: <br /> <br />MULTIPLE DWELLINGS: For the purposes of this section only, <br />any building used for residential purposes consisting of more <br />than four dwelling units with individual kitchen facilities for <br />each. <br /> <br />Section 2. That Section 602.02 of the City of Elk River <br />Code of Ordinances titled "General Regulations" be amended to <br />add: <br /> <br />8. Occupants of multiple dwelling properties shall have the <br />the same opportunity to recycle afforded to occupants of other <br />residential dwelling units. It is unlawful after January 1/ <br />1992/ for any multiple dwelling owner, association or joint <br />management entity to negotiate, execute, or maintain a contract <br />for mUltiple dwelling garbage or other refuse collection unless <br />it includes, as part of that contract or as part of a separate <br />contract, a minimum of biweekly collection of recyclables or <br />deemed adequate by the City of Elk River. <br /> <br />Section 3. That Section 602.08 of the City of Elk River <br />Code of Ordinances titled "Licensing of Collectors and Haulers" <br />be amended to add: <br /> <br />5. As part of the licensing requirement all haulers serving <br />multiple dwelling properties must offer recycling service of <br />metal cans, newspaper, clear glass, and plastics. The hauler <br />will be responsible to provide adequate containers as judged by <br />the City of Elk River to store each recycled material. The <br />hauler may contract these services out. <br /> <br />Section 4.
