<br />PROCEDURES FOR
<br />ADMINISTRATIVE
<br />SUBDIVISIONS
<br />,The City Council of the City of Elk
<br />River hereby amends its City Code of
<br />Ordinances, Section 1008.08, Subd. 2,
<br />and does ordain as follows: '
<br />SectionL The Code of Ordinances
<br />Section 1008.08, Subd. 2, is hereby
<br />amended to read as follows:
<br />2. Administrative Subdivision
<br />a. Purpose. The Administrat!ve
<br />Subdivision procedure for processmg
<br />applications for the division of land is
<br />intendedto provide an expedited, Pro~-
<br />dure in those limited cases where stnct
<br />adherence to the standard platting
<br />process is not required. The A~nis-
<br />trative Subdivision procedure IS not
<br />intended to be a ,substitute for the stan-
<br />dard plattillg process set forth in Sec-
<br />tion 1008.08, Subd. 1. Administrative
<br />Subdivision procedures may be utilized
<br />where the following circumstances ex-
<br />ist.
<br />i. The property to be divided will re-
<br />sult in four or less lots.
<br />ii. The property to be divided will not
<br />require the dedication of public right-
<br />of-way.
<br />iii. The property has ,not been the
<br />subject of division by the Administra-
<br />tive Subdivision procedure in the previ-
<br />ous two years.
<br />iv. The new parcels will result in a
<br />platted legal description except in the
<br />case of the creation of one new agricul-
<br />tural or one new single family residen-
<br />tial zoned parcel.
<br />b. Procedure. Except as hereinafter
<br />specifically provided, administrative
<br />subdivisions shall conform to all stan-
<br />dards, procedures and requi~~~nts
<br />applicable to standard subdiVISions
<br />under this Ordinance.
<br />i. Prior to formal application, sketc~
<br />plans and preliminary and final pl~t, if
<br />required~ shall be revi.ewed,' by the
<br />Concept Review ,Conumttee for s',lb-
<br />mission of a written recommendatIOn
<br />thereon to the Qity Qouncil. Adminis-
<br />trative 8l,lbdivisions' do not require
<br />review by the Planning Cormnission
<br />unless required by referr~ of the Ci~y
<br />Council. The Concept ReVIew COmmIt-
<br />tee shall initially determine andrecom-
<br />mend to the City Council the extent to
<br />wNcb, Illladmin~trative subdivision
<br />shall be subject to the requirements of
<br />this Ordinllllce.,
<br />ii. After the Concept Review Commit-
<br />tee has submitted its recommendati!ln
<br />through the Zoning Administrator to
<br />the Council concerning the proposed
<br />administrative subdivision, the City
<br />
<br />Council shall hold a public hearing
<br />thereon after notice of the date, time,
<br />place and purpose thereof has been
<br />published once in the official newspa-
<br />per at least ten (10) days before the date
<br />of the hearing. The consolidation and
<br />approval of the plat may consolidate
<br />the preliminary and fmal plat app:rpval
<br />in the same action.
