<br />e <br /> <br />ORDINANCE 91 - 7 <br />CITY COUNCIL OF THE CITY OF ELK RIVER <br /> <br />AN ORDINANCE AMENDING SECTION 1008.08, SUBD 2, OF THE <br />SUBDIVISION REGULATIONS RELATING TO PROCEDURES FOR <br />ADMINISTRATIVE SUBDIVISIONS <br /> <br />The City Council of the City of Elk River hereby amends its <br />City Code of Ordinances, Section 1008.08, Subd. 2, and does <br />ordain as follows: <br /> <br />Section 1. The Code of Ordinances Section 1008.08, Subd. 2, is <br />hereby amended to read as follows: <br /> <br />2 . <br /> <br />Administrative Subdivision. <br /> <br />e <br /> <br />a. ~urpose. The Administrative Subdivision procedure <br />for processing applications for the division of land is <br />intended to provide an expedited procedure in those <br />limited cases where strict adherence to the standard <br />platting process is not required. The Administrative <br />Subdivision procedure is not intended to be a substitute <br />for the standard platting process set forth in Section <br />1008.08, Subd. 1. Administrative Subdivision procedures <br />may be utilized where the following circumstances exist. <br /> <br />i. The property to be divided will result in four or <br />less lots. <br /> <br />ii. The property to be divided will not require the <br />dedication of public right-of-way. <br /> <br />iii.The property has not been the subject of division <br />by the Administrative Subdivision procedure in the <br />previous two years. <br /> <br />iv. The new parcels will result in a platted legal <br />description except in the case of the creation of one <br />new agricultural or one new single family residential <br />zoned parcel. <br /> <br />b. P~ocedure. Except as hereinafter specifically <br />provided, administrative subdivisions shall conform to all <br />standards, procedures and requirements applicable to <br />standard subdivisions under this Ordinance. <br /> <br />e <br /> <br />i. Prior to formal application, sketch plans and <br />preliminary and final plat, if required, shall be <br />reviewed by the Concept Review Committee for <br />submission of a written recommendation thereon to the <br />City Council. Administrative subdivisions do not <br />require review by the Planning Commission unless <br />required by referral of the City Council. The <br />
