The Building <br />and Zoning Administrator shall be responsible for <br />recording in writing instances of nonconforming uses which <br />have been discontinued for a period of twelve (12) months <br />and shall also be responsible for providing written <br />notification of the same to the appropriate party. <br /> <br />E. If any nonconforming use or structure is destroyed by <br />any means, including floods, to an extent of 50 percent <br />(50%) or more of its market value at the time of <br />destruction, it shall not be reconstructed except in <br />conformity with the provisions of this Ordinance. The <br />applicable provisions for establishing new uses or new <br />structures in Sections 902.06 and 902.08 will apply <br />depending upon whether the use or structure is in the <br />Floodway or Flood Fringe District, respectively. <br /> <br />902.20 - Penalties For Violations. <br /> <br />e <br /> <br />1. Violations of the provisions of this Ordinance or failure <br />to comply with any of its requirements (including violations of <br />conditions and safeguards established in connection with grants <br />of Variances or Conditional Uses) shall constitute a <br />misdemeanor. Any person who violates this Ordinance or fails <br />to comply with any of its requirements shall upon conviction <br />thereof be fined not more than Five Hundred Dollars ($500) or <br />imprisoned for not more than ninety (90) days, or both, and in <br />addition shall pay all costs and expenses involved in the <br />case. Each day such violation continues shall be considered a <br />separate offense. Nothing herein contained, including the <br />imposition of a criminal penalty, shall constitute a waiver of <br />the right of the City or others to secure abatement of <br />violations by injunction or other civil legal remedy. <br /> <br />2. Nothing herein contained shall prevent the City from <br />taking such other lawful action as is necessary to prevent or <br />remedy any violation. Such actions may include but are not <br />limited to: <br /> <br />e <br /> <br />A. In responding to a suspected Ordinance violation, the <br />Building and Zoning Administrator and the City may utilize <br />the full array of enforcement actions available to it <br />including but not limited to prosecution and fines, <br />injunctions, after-the-fact permits, orders for corrective <br />measures or a request to the National Flood Insurance <br />Program for denial of flood insurance availability to the <br />guilty party. The City must act in good faith to enforce <br />these official controls and to correct Ordinance <br />violations to the extent possible so as not to jeopardize <br />its eligibility in the National Flood Insurance Program. <br /> <br />B. When an Ordinance violation is either discovered by <br />or brought to the attention of the Building and Zoning <br />Administrator, the Building and Zoning Administrator shall <br />
