<br />e <br /> <br />iv. A copy of the preliminary plat shall be referred <br />to the Park and Recreation Commission. The Park and <br />Recreation Commission shall make a recommendation to <br />the Planning Commission and City Council prior to the <br />public hearing on the preliminary plat. <br /> <br />v. The Planning Department shall submit copies of the <br />preliminary plat to the Sherburne County Highway <br />Department, Minnesota Department of Transportation and <br />other appropriate agencies (where applicable) . <br /> <br />e <br /> <br />vi. Within sixty (60) days of receipt by the City of a <br />complete application for preliminary plat approval <br />including all required supporting materials, the <br />Planning Commission shall hold a public hearing on the <br />proposed subdivision. The required legal publication <br />shall be made and notices shall be sent to all property <br />owners of record within three hundred fifty (350) feet <br />of the exterior boundaries of the proposed plat and <br />within three hundred fifty (350) feet of all contiguous <br />property owned or controlled by the subdivider or the <br />owner. The developer is required to obtain the above- <br />mentioned property owners list from the Sherburne <br />County Auditor's office. <br /> <br />v~~. The subdivider or a duly authorized representative <br />shall attend the Planning Commission meetings at which <br />the proposal is scheduled for consideration. <br /> <br />viii. At the public hearing, the Planning Commission <br />shall receive the written report of the Planning <br />Department and shall take testimony from the subdivider <br />and all other interested persons. At the close of the <br />public hearing, the Planning Commission shall consider <br />all of the written reports and materials before it, and <br />the oral testimony, and make a recommendation on the <br />preliminary plat to the City Council. The Planning <br />Commission may recommend approval, approval subject to <br />conditions or that the preliminary plat be denied. If <br />denial is recommended, the reasons for that <br />recommendation shall be stated in the record. <br /> <br />e <br /> <br />ix. Following action by the Planning Commission, the <br />City Council shall consider the preliminary plat. The <br />City Council shall make its decision on the preliminary <br />plat within one hundred twenty (120) days following <br />receipt by the City of the properly completed <br /> <br />10.23 <br />
