will meet the qualifications for issuance of a certificate of occupancy, or that the Project will <br />meet the requirements of the Developer or any other users of the Project. Approval of the <br />Construction Plans, or any proposed amendment to the Construction Plans, by the City will not <br />constitute a waiver of an Event of Default or of any State or City building or other code <br />requirements that may apply. Nothing in this Agreement shall be construed to relieve the <br />Developer of its obligations to receive any required approval of the Construction Plans from any <br />department of the City and does not relieve the Developer of the obligation to comply with <br />applicable federal, State and local laws, ordinances, rules and regulations, or to construct the <br />Project in accordance therewith. <br />Section 3.6. Commencement and Completion of Construction. Subject to the terms <br />and conditions of this Agreement and to Unavoidable Delays, the Developer will commence <br />construction of the Phase One Project by Deeember 3March 15, 24242022 and shall <br />substantially complete the Phase One Project by June 30, 2Q232024. Subject to the terms and <br />conditions of this Agreement and to Unavoidable Delays, the Developer will commence <br />construction of the Phase Two. Project by December 31, 2-0232024 and shall substantially <br />complete the Phase Two Project by June 30, 2Q42027. The Project will be constructed by the <br />Developer on the Development Property in conformity with the Construction Plans approved by <br />the City. Prior to completion, upon the request of the City, and subject to applicable safety rules, <br />the Developer will provide the City reasonable access to the Development Property. <br />"Reasonable access" means at least one site inspection per week during regular business hours. <br />During construction, marketing and rentals of the Project, the Developer will deliver progress <br />reports to the City from time to time as reasonably requested by the City. <br />12 <br />EL185-50-718703.v2 <br />
