B-7 <br /> <br />(e) Notwithstanding Section 6.4 of the Lease, Landlord shall require Contractor <br />maintain adequate builder’s risk insurance for at least the value of the Building Addition and all <br />sums expended therefor, and any increased costs associated therewith will be included in the Cost <br />Proposal. Landlord reserves the right, in its sole discretion, to instead carry adequate Builder’s <br />Risk insurance with respect to the Building Addition and all sums expended therefor and net the <br />cost, expense and premiums from the Tenant Allowance. <br />(f) If it is determined by Landlord and Tenant that the Building Addition Work will <br />not receive required City permits and approvals, then Tenant must immediately reimburse <br />Landlord for all of Landlord’s out of pocket costs incurred as of such time for the Building <br />Addition Work, including the cost of the Preliminary Addition Plans, Final Plans, Cost Estimate, <br />contract termination fees and costs to apply for any permits and approvals.
