An E-bike has a <br />rechargeable battery-operated motor that assists an operator with the peddling of the bicycle over uneven or <br />hilly terrain. According to state statute, a governing body may not prohibit or restrict operations of an electric- <br />assisted bicycle on any bikeway or roadway unless the governing body can determine it is unsafe. Which is an <br />ADA protection. <br /> <br />MORC has indicated E-bikes are not determinantal to the mountain bike community or the trails. A new <br />ADA regulation requires public agencies to review their policies to permit the reasonable use of power-driven <br />“mobility devices” which includes electric bikes (ADA Title II Sec. 35.137). <br /> <br />MORC brought to our attention the growing use of electric skateboards or one-wheel devices which are <br />currently not classified under state statute.
