Monday - Friday 7:00 AM until 9:00 PM <br />Saturday 8:00 AM until 5:00 PM (only with 48 hour advance notice to the City <br />Engineer or their representatives) <br />Sunday Not Allowed <br />This does not apply to activities that are required on a 24-hour basis such as dewatering, etc. Any <br />deviation from the above hours is subject to approval of the City Council. <br />(04)Street Construction. No street construction will be allowed after October 15or prior to <br />May 15 unless approved by the City Engineer. <br />(05)Snowplowing. Until the Improvements are accepted by the City or an agreement expressly <br />reached in advance, the developer is responsible for snow removal and ensuring access by Emergency <br />Response equipment. <br />(06)Mailboxes. All mailboxes be clustered, and in a style and location acceptable to the City of <br />Elk River. <br />(07)History. Any item or condition found that indicates the site is likely to yield information <br />important to pre-history or history shall be reported to the city immediately, and the city reserves the <br />right in such event, to stop work immediately until the subdivision is appropriately investigated and <br />developer is authorized to recommence work. <br />11.Park Dedication. Developer shall satisfy park dedication requirements through a cash <br />donation equal to the low-density Park Dedication fee identified in the city’s fee schedule at the time of <br />Final Plat recording. The current amount is Sixty-Four Thousand, One Hundred Sixty-Six and 85/100 <br />dollars ($62,740.92), ($1,425.93 per lot). <br /> <br />12.Trott Brook Crossing. Final platting and development of any additional subdivisions in the <br />Miske Meadows preliminary plat will require that the subdivisions within the preliminary plat be <br />connected to the City street system via a crossing of Trott Brook on Twins Lakes Parkway (the <br />"Crossing"). The Developer agrees that no more final plats within Miske Meadows preliminary plat will <br />be approved until installation of the Crossing has been commenced by Developer or a petition and <br />waiver, on a form required by the City, has been submitted to the City petitioning the City to install the <br />Crossing as a public improvement project under Minnesota Statutes, Chapter 429 and to assess the costs <br />of the project to the parties petitioning as provided in the petition and waiver. <br />If the owners of the properties benefitted by the Crossing do not jointly submit a petition and waiver <br />to have the Crossing installed, Developer may petition the City to install the Crossing as a public <br />improvement project pursuant to Chapter 429 of Minnesota Statutes, or the City may initiate a <br />Chapter 429 project to install the Crossing. If a Chapter 429 project is initiated, the City will have all <br />of its rights under Chapter 429, including its right to determine whether to proceed with the Crossing <br />project. The City shall have no liability to the Developer if a decision is made not to proceed with the <br />Crossing as a public improvement project. If the Crossing is installed as a Chapter 429 project, the <br />final costs of the Crossing project, and the allocation of those costs to the benefitted properties, will <br />be as determined in the Chapter 429 proceeding. <br /> <br />13.Development Plan. A development plan “Development Plan” shall be submitted by <br />Developer and approved by the City Engineer or his designee prior to issuance of any building permit <br />within the Subdivision.
