Based on the R1-c zoning,the property is allowed two detached accessory structures not to exceed 1,200 square feet and 15 <br /> feet in height. Where a zoning lot has more than 1,000 linear feet of combined street frontage,the total sign area shall not exceed <br /> 192 square feet with no more than 96 square feet per sign. This zoning lot qualifies for the additional square footage. <br /> Freestanding signage shall not exceed 20 feet in height. The variance is: <br /> 1. Is in harmony with the general purpose and intent of the ordinance, and <br /> The general purpose and intent is to regulate accessory structures and signage for a single use/business on <br /> a single parcel. In this instance,the properties are a campus that benefits the community with varying <br /> needs at varying times. The campus is comprised of four parcels, each of which technically are allowed <br /> their share of accessory structures and signs. In this case, the athletic complex is a shared entity among the <br /> school properties and requesting to place the accessory structures in locations that relate to the uses,not <br /> the parcels. The general purpose and intent are met. <br /> 2. Is consistent nith the City of Elk River comprehensive plan. <br /> The properties are guided for Public/Institutional uses and are allowed in the zoning district. The use will <br /> be consistent with the Comprehensive Plan. <br /> Variances may be granted when the petitioner establishes that there are practical difficulties in complying with the <br /> zoning ordinance. Practical difficulties means that: <br /> 3. The petitionerproposes to use theproperty in a reasonable manner notpermitted by the Zoning ordinance; <br /> The uses are not unreasonable to the area as the institutional uses have been in existence for decades and <br /> the applicant is proposing to use the properties in the same manner. <br /> 4. The plight of the petitioner is due to circumstances unique to the property not a consequence of the petition's own action or <br /> inaction;and <br /> The unique circumstance is the campus is comprised of four parcels with an athletic complex that is a <br /> shared entity among the school properties. <br />
