During the public hearing, the applicant indicated they did not agree with condition #6 which stated: The applicant <br />shall submit a cash escron,, in the amount of $$5,000 to ensure compliance nvith the Interim Use Permit conditions. They stated they <br />have already spent a great deal of money cleaning up the property and tying up $5,000 for an uncertain amount of <br />time would be a financial burden for them and they have no intention of selling property in the foreseeable future. <br />The Commission discussed the acceptable length for this IUP. They were concerned with the comments made by <br />the applicant that they had no intention of selling the property in the foreseeable future. The Commission believes <br />this is not the intent of the IUP process. <br />Most of the Commissioners agreed with the applicant's statement regarding the escrow and discussed other <br />options, such as a letter of credit. The Commission recommended approval of the request, removing condition <br />#6, by a 5-2 vote. The two opposing Commissioners wanted a condition addressing the escrow/letter of credit. <br />The Commission believed the City Council could include a condition, if they felt necessary, addressing the <br />escrow/letter of credit. <br />The $5,000 escrow condition was introduced in March of 2020 with a IUP request asking for the same temporary <br />use allowing a multiple family dwelling to be located on a single-family property.
