10.5.2020 CC Meeting 10.2 at1 <br /> <br />Animal holding areas 17 fixture units 1 <br /> <br />Animal runs 34 fixture units 1 <br />Archery (6 feet/lane) 6 lanes 1 <br />Arenas (bleachers 18 inches/person) 110 seats 1 <br /> <br />Assisted living <br /> <br />(See formula below to determine the number of residents) <br /> <br />No washer/dryer in each unit 3 residents 1 <br /> <br />Washer/dryer in each unit 2.5 residents 1 <br /> <br /> <br />(e) The city council, at its discretion and upon a finding that the table in subsection 78-189(d) <br />may not apply due to circumstances unique to a particular user, may enter into an agreement to <br />calculate the number of SAC units for commercial, public, or institutional facilities based on one <br />of the following alternative methods: <br />(1) Information is provided regarding actual water and sewer use by the same or a <br />substantially similar use that has been existing for a period of not fewer than three years; or <br />(2) The user shall escrow the SAC charge calculated in accordance with subsection 78-189(d) <br />and monitor actual water use for a period of four years. If the actual average water and sewer <br />nd rd th <br />use during the 2 , 3 and 4 years is fewer than the SAC units estimated by the table in <br />subsection 78-189(d), the city will recalculate the SAC units and refund the difference to the <br />user without interest. If the actual water and sewer use during the fourth year is greater than <br />the SAC units escrowed as calculated by the table in subsection 78-189(d) the user will not be <br />obligated to pay additional fees and the escrowed funds will be released and deposited into <br />the sewer fund. <br />(Code 1982, § 1302.10; Ord. No. 09-13, § 1, 12-21-2009; Ord. No. 13-13, § 1, 6-3-2013) <br /> <br />SECTION 2. That Section 78-41 of the City of Elk River Code of Ordinances shall be amended to <br />read as follows: <br /> <br />Sec. 78-41. – Rates and charges generally. <br />(a) These are established in the city: <br />(i) Water Access Charges, consisting of a water availability charge and a water <br />connection charge, and <br />(ii) Water utility user charges and rates. <br /> <br />(b) Water availability charges are due and payable at the time property services by the water <br />utility is final platted into buildable lots. <br /> <br />(c) Water connection charges are due and payable at the time of connection of a building to the <br />water utility, or at the time connection is required to be made to the water utility pursuant to <br />Section 78-21. <br /> <br />(d) User charges and rates are due and payable in such amounts and at such times as required by <br />the public utilities commission. <br /> <br />(e) Each charge and/or rate shall be in the amount established by duly adopted resolution of the <br />city council or the public utilities commission. <br />Last Updated January 2019 <br />
