CITY OF ELK RIVER, MINNESOTA <br />NOTICE OF PUBLIC HEARING <br />NOTICE IS HEREBY GIVEN that the City Council (the "Council') of <br />the City of Elk River, Minnesota (the "City', will hold a public hear- <br />ing at a meeting of the Council beginning at 6:30 p.m., on Monday, <br />October 5, 2020, to be held at the Elk River City Hall,13065 Orono <br />Parkway, Elk River, Minnesota on the proposal to modify the Devel- <br />opment Program for Development District No.1 (the "Project Area') <br />to establish Tax Increment Financing (Economic Development) Dis- <br />trict No. 26 within Development District No. 1 (Shoot Steel, Inc. <br />Project) (the 'TIF District'); all pursuant to and in conformity with <br />applicable law, including Minnesota Statutes, Sections 469.124 <br />through 469.133, as amended, and 469.174 through 469.1794, as <br />amended (together, the "TIF Act'), and to review the Tax Increment <br />Financing Plan (the "Plan') for the TIF District. A copy of the Plan <br />for the TIF District and all documents relating to the proposed mod- <br />ification to the Development Program for Development District No. <br />1 to establish the TIF District as an economic development district, <br />will be on file and available for inspection at City Hall during regular <br />business hours. <br />Adjacent to this notice is a map which shows the area of the pro- <br />posed TIF District and the boundaries of the Project Area where the <br />increments may be collected and expended, respectively, pursuant <br />to the TIF Act. <br />In addition, the City proposes entering into an agreement with <br />Shoot Steel, Inc., or an affiliate thereof or entity related thereto (the <br />"Developer) under which the City will provide tax increment as- <br />sistance to the Developer, and the Developer will agree to acquire <br />approximately 4.34 acres of land within the City and construct and <br />equip an approximately 20,000 square foot warehouse facility and <br />associated office space on the property. The assistance will be a <br />"business subsidy" under Minnesota Statues, Sections 116J.993 <br />to 116J.995, as amended (the "Business Subsidy Law'J. A copy of <br />the proposed business subsidy agreement is on file and available <br />for public inspection at the office of the City's Economic Develop- <br />ment Director in City Hall. <br />A person with residence in or the owner of taxable property in the <br />City may file a written complaint with the City if the City fails to <br />comply with the Business Subsidy Law, and no action may be filed <br />against the City for the failure to comply unless a written complaint <br />is filed. <br />At the time and place fixed for the public hearing, the Council will <br />give all persons who appear or submit comments in writing prior <br />to the hearing, an opportunity to express their views with respect <br />to the proposal. Interested persons may file written comments re- <br />specting the proposal with the City Clerk at or prior to said public <br />hearing. <br />PLEASE NOTE, due to COVID-19, the public hearing may be con- <br />ducted via telephone or other electronic means as allowed under <br />Minnesota Statutes, Section 13D.021.
