The property has been zoned R-1a <br />Single-family Residential or agricultural since annexation. The owner intended to operate as a two-family (duplex) <br />rental which city ordinances prohibit. The owner stated that she spoke with Elk River Municipal Utilities prior to <br />purchase to verify the presence of two utility meters and noted inspection stickers on the electrical panel. She <br />interpreted this to mean the property was approved by the city to operate as a duplex. <br />Unfortunately, neither constitute approval of a duplex by the zoning authority or the city. The Sherburne County <br />Assessor's Office classifies the property as a single-family use as far back as their records indicate. The building <br />permit history also shows permit applications identifying the parcel as single-family. <br />Options to meet the owner's desire are an Interim Use Permit to allow the use on a temporary basis or a zone <br />change to R-2a, which supports two-family units (duplex). The city has previously approved both options for <br />parcels within the urban service district.
