<br />e <br /> <br />ORDINANCE 94 - 09 <br /> <br />CITY OF ELK RIVER <br /> <br />AN ORDINANCE AMENDING THE CITY OF ELK RIVER <br />ZONING MAP TO REZONE CERTAIN PROPERTY <br />FROM <br />R1E (SINGLE FAMILY RESIDENTIAL) <br />TO <br />PUD (PLANNED UNIT DEVELOPMENT) <br />CASE NO. ZC 94-05 <br /> <br />The City Council of the City of Elk River does hereby ordain as follows: <br /> <br />Section 1. The duly adopted Zoning Map of the City of Elk River is <br />hereby amended to rezone the property described as: <br /> <br />e <br /> <br />That part of the south 928.55 ft. of the SW 1/4 of the NE 1/4 Section 27, <br />Township 33, Range 26, Sherburne County, MN, lying west of Hillside Estates <br />1st Addition and lying east of Highway 169. Parcel of land lying north of above <br />mentioned legal description, extending easterly line of above mentioned legal <br />description 50 ft. from that point westerly to a point lying northerly of west line <br />of above mentioned legal description extended 100 ft. containing 1.07 acres plus <br />or minus, <br /> <br />from RIE (Single Family Residential) to PUD (Planned Unit Development) based <br />on the following findings: <br /> <br />1. The rezoning will be consistent with the Comprehensive Land Use Plan <br />designation of HB (Highway Business). <br /> <br />2. The rezoning is a minor extension of the existing commercial zoning and <br />land use designation, and will not adversely impact the surrounding <br />properties. <br /> <br />3. The rezoning is consistent with the existing Growth Management Plan <br />whereby commercial is anticipated to be extended north to 197th Avenue. <br /> <br />e <br />
