"'t <br />City of <br />Elk <br />River <br />City of Elk River <br />City Council <br />Resolution 20- <br />A Resolution of the City Council of the City of Elk River Approving the <br />Conveyance of Certain Property (PID 75-127-4302) to Elk River Municipal <br />Utilities <br />WHEREAS, the City of Elk River (the "City") is the fee owner of the following described <br />property: That part of the Southwest Quarter of the Southeast Quarter of Section 27, <br />Township 22, Range 26, Sherburne County, Minnesota, described as follows: <br />Commencing at the Southwest corner of said Southwest Quarter of the Southeast Quarter <br />of Section 27; thence Easterly along the South line of said Southwest Quarter of the <br />Southeast Quarter of Section 27 a distance of 507.6 feet more or less to the Westerly right- <br />of-way of U.S. Highway No. 169 and the point of beginning of the parcel to be described; <br />thence Northerly along said Westerly right-of-way a distance of 208.0 feet; thence Westerly <br />parallel with said South line of the Southwest Quarter of the Southeast Quarter a distance of <br />218.7 feet; thence Southerly parallel with said Westerly right-of-way of U.S. Highway No. <br />169 a distance of 208.0 feet to said South line of the Southwest Quarter of the Southeast <br />Quarter of Section 27; thence Easterly along said South line to the point beginning. (the <br />"Property"); and <br />WHEREAS, the City desires to convey the Property to Elk River Municipal Utilities, a <br />Minnesota municipal utility ("ERMU"); and <br />NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Elk <br />River, Minnesota, by at least four -fifths vote: <br />The conveyance of the Property by the City to EMRU has no relationship to <br />the City's Comprehensive Plan and therefore, review of the conveyance by the <br />Planning Commission pursuant to Minnesota Statutes Section 462.356, <br />subdivision 2 is not required. <br />2. The City hereby approves the conveyance of the above described Property to <br />ERMU. <br />3. The Mayor and City Clerk are hereby authorized and directed to take all <br />actions necessary to convey the Property to ERMU, including execution of <br />any and all documents needed for the conveyance and to effectuate the intent <br />of this Resolution. <br />PV0WIHE1 ®V <br />NAf UR <br />
