City of <br />Elk — <br />River <br />City of Elk River <br />City Council <br />Resolution 20- <br />A Resolution of the City Council of the City of Elk River Approving the <br />Conveyance of Certain Property (PID 75-574-0010) to Elk River Municipal <br />Utilities <br />WHEREAS, the City of Elk River (the "City") is the fee owner of the following described <br />property: <br />Outlot A, Hillside Estates Fourth Addition, Sherburne County, Minnesota <br />(the "Property"); and <br />WHEREAS, the City desires to convey the Property to Elk River Municipal Utilities, a <br />Minnesota municipal utility ("ERMU"); and <br />NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Elk <br />River, Minnesota, by at least four -fifths vote: <br />1. The conveyance of the Property by the City to EMRU has no relationship to <br />the City's Comprehensive Plan and therefore, review of the conveyance by the <br />Planning Commission pursuant to Minnesota Statutes Section 462.356, <br />subdivision 2 is not required. <br />2. The City hereby approves the conveyance of the above described Property to <br />ERMU. <br />3. The Mayor and City Clerk are hereby authorized and directed to take all <br />actions necessary to convey the Property to ERMU, including execution of <br />any and all documents needed for the conveyance and to effectuate the intent <br />of this Resolution. <br />Passed and adopted this day of 2020. <br />John J.
