'_"t City of Elk River City of Elk River City Council Resolution 20- A Resolution of the City Council of the City of Elk River Approving the Conveyance of Certain Property (PID 75-402-0082) to Elk River Municipal Utilities WHEREAS, the City of Elk River (the "City") is the fee owner of the following described property: That part of Lot Eight (8) Auditor's Subdivision No. 3 lying Northerly of a line commencing at a point on the West Line of said Lot Eight (8), 360 feet distant North of the iron pipe at the Southwest corner of said Lot Eight (8) to the Great Northern Railroad right-of-way and there terminating; and West of a line running parallel with and 240 feet distance East of the West line of said Lot Eight (8). Together with the right to enter upon the East Ten (10) feet of the West Seventy (70) feet of the South 373 feet of Lot Eight (8), Auditor's Subdivision No. 3 for purposes of placement, construction, operation, repair and maintenance of a water main. (the "Property"); and WHEREAS, the City desires to convey the Property to Elk River Municipal Utilities, a Minnesota municipal utility ("ERMU"); and NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Elk River, Minnesota, by at least four -fifths vote: The conveyance of the Property by the City to EMRU has no relationship to the City's Comprehensive Plan and therefore, review of the conveyance by the Planning Commission pursuant to Minnesota Statutes Section 462.356, subdivision 2 is not required. 2. The City hereby approves the conveyance of the above described Property to ERMU. 3. The Mayor and City Clerk are hereby authorized and directed to take all actions necessary to convey the Property to ERMU, including execution of any and all documents needed for the conveyance and to effectuate the intent of this Resolution.
