<br /> <br />Request for Action <br /> <br /> <br /> <br /> <br />To Item Number <br />Mayor and City Council 9.4 <br />Agenda Section Meeting Date Prepared by <br />Work Session June 15, 2020 Tina Allard, City Clerk on behalf of Ron <br />Nierenhausen, Police Chief <br />Item Description Reviewed by <br />Open Containers in Public Places Cal Portner, City Administrator <br />Reviewed by <br /> <br /> <br />Action Requested <br />Council discussion and staff direction on open containers throughout public areas of Elk River. <br /> <br />Background/Discussion <br />Section 6-3 of the Elk River City Code states the following: <br /> <br />6.3 Consumption in public place. <br /> No person shall consume liquor on a public highway or public place. <br /> <br />State law only addresses open containers in vehicles, which is not allowed. <br /> <br />Practice has been to allow alcohol and open containers in city parks. Aegir Brewing Company would like <br />open containers allowed in the downtown. <br /> <br />General information nationwide on where allowed: https://www.wideopeneats.com/states-can-drink- <br />public/ <br /> <br />Liability issues could be a concern.
